No. LGL. 138/91/22.— The following Act of the Assam Legislative Assembly which received the assent of the President is hereby published for general information.

(Received the assent of the President on 30.3.93) THE BENGAL, AGRA AND ASSAM CIVIL COURTS (ASSAM AMENDMENT) ACT, 1992.
An ACT
further to amend the Bengal, Agra and Assam Civil
Courts Act, 1887, in its application to the State of Assam.
Whereas it is expedient to amend the Bengal, Agra and Assam Civil Courts Act, 1887, hereinafter called the principal Act, in its application to the State of Assam, in the manner hereinafter appearing;
It is hereby enacted in the Forty-Third Year of the
Republic of India as follows
1.(1) This Act maybe called the Bengal, Agra and Assam Civil Courts (Assam Amendment) Act, 1992.
It shall extend to the whole of the State of Assam.
It shall come into force at once.
2.(1) In section 19 of the principal Act, in subsection (1), for the words "three thousand rupees" the words "seven thousand rupees" shall be substituted.
In section 19 of the principal Act, in sub-section (2) for the words "ten thousand rupees" the words "twentyfive thousand rupees" shall be substituted.
In section 21 of the principal Act, in subsection (1), in clause (a), for the words "twenty thousand rupees", the words "fifty thousand rupees" shall be substituted.

Retrospective operation.

(1) The provision of clause (a) of sub-section (1) of section 21 of the principal Act, as amended by section 3 of this Act, shall apply irrespective of the fact that suits, proceedings, decrees or orders out of which the appeals referred to therein arise, were instituted or made prior to the commencement of this Act.
Notwithstanding anything to the contrary contained in the Limitation Act, 1963, an appeal from a decree or order made before the commencement of this Act,' which but for the provisions of this Act, would have been preferred before the High Court within ninety days from the date of such decree or order shall be preferred to the District Judge, within the said period.
Nothing in this Act shall be deemed to affect any appeal instituted prior to the Commencement of this
Act.
