3 . (1) The Government shall constitute a Board to be inc7ro· called the Asom Rastrabhasa Prachar Board for the purpose of taking over the management and control of the .samiti consisting of not more than '13 members : Constitution ~~= oRth~ tr abbasa ; ; ,,. c:hlll" Board. Provided that if the Board . is constituted with less t han 13 members , the Government may at any time, appoint such other member or members as. may be considered necessary, the totai number of members of the .Board not exceeding 13, excluding the Secretary: . Provided further that the Board may exercise all powers and duties under this Act notwithstanding that the number of members of the Board is at any time less than the total permissible strength of 13. The Board shall be constituted with the following persons: PRESIDENT : - (a) The Chief Minister. Assam , VICE-PRESIDENT :- _ (b) The Education Minister , Assam. MEM·BERS:- (c) Secretary to the Government of Assam, Education Department . i . . p (d) Director of Public Instruction, Assam. (e) Secretary' to the Government p.f Assatn, Finance Department (h) . p (f) 3 (three) persons with outstanding contribution to Hindi to be nominated by the President. (g) The Managing Direct.qr, iAssam t.rext tBook Corporation. (h) 4 (four) representative members belonging to ethnic and religious groups as may be nominated by the Government . ' , The Board shall be a body corporate having perpetual succession and a common seal and shall sue and be sued bv the name of Asam Rastrabhasa P .r .rachar Board. 1 .J 1 .. ' 0 . All employees of the Samiti shall be deemed to be the employees of the Board and shall be entitled to such emoluments as were admissible to them immediately before. the commencement of this Act . Provided that- The Board may with prior approval of Govern · ment make any addition or alterati1m of the emoluments and conditions of service of the employees; and Any appointment to any post of the Board minimum of pay scale of wpich is Rs. 750 p.m. or above shall be done only with prior approval of the Government. (2)' If any person,' without any reasonable excus ,e ,e, knowingly and wilfully makies default in complying with the requirements of the pr€ceding sub-section, he shall be punishable with imprisonment which may extend to six months or with fine which may extend to two thousand rupees or with both . Duties uf th e Board. 7. (1) The Board shall take all such steps as may be necessary for the purpose of effe ctive exercise of the powers of management and control over the affairs and properties of Sarni ti. The Board may also perform such other duties as the be were the duties of the Samiti immediately before commencement of this Act hi such manner as. may prescribed. The Board may form such number of Commit ees or sub -committees to assign differ ent functions of the Board .-with such powers, function and number of memb,ers as may determined by the Board. ( 4) The Board shall have all powers for advancement of the objects of the Samiti. the Power of tie Board. 8. (1) The Board shall prepare budget within a Board. period of one month froni the date of first constitution of the Board for the remaining period of the current financial year and shall· submit the same to the Government for approv.al and the Government may approve the same with such modification as be deemed fft oi:- without any modification. · . -/ - . F For succeedin.££ financial \ year the Board shall prepare the Budget vvithin 15th day of February immediately preceding the commencement of the financial year for which the Budget is to be prepared and submit to the Government for approval. The Government shall approve the budget with or without modification. The budget shall have effect as approved by the · Government. (1) If the Government is of the opinicm that the Board is unable to perform, or tias persistently ,m ,made default J n the performance of the duties imposed on it by or under this Act or has exceeded or abused its powers, the Government may, by notification, supersede the Board for such period as may be specified in the notification-: ,,.. (a) all the members of the Board shall, as from the date of , supersession vacate their offices as sµch members; · (b) all the duties and powers of the Board under this Act shall. during the period of supersession, be· the performed and exercised by such person as Government may direct ; and (c) all property vested in the Board shall, during the · period of supersession, vest in the Government. The Government may,- (a) extend the period\ of suoersession for such further term as it may consider necessary; or (b) reconstitute the Board at any time in lthe manner provided in · Section 3 of this Act. Condition of 13. (1) A member of the Board may resign his offfice membership by gi .v .ving notice in writing to the Government and· shall, ef the Board. on such resignation being accepted by the be deemed to have vacated his office. The teri:n of office of each member of the Board shall be such as may be specified in the Notification constituting the Board. not being than three years : Provided that the Government may change the comoosition of the Board at any time before the expiry of the term of the office cif the members. A casual vacancy in the office of a member of the Board shall be filled by fresh nomination by the Government and the new member so nominated to fill the vacancy shall hold office only for the remainder of the term for which the member· whose place is filled was nominated.
