9 ^ I It i» hereby enacted in the Tw enty- third Year of the Republic of Ind ia as follows: — Short title, 1 · (1) This Act m ay be called the Assam Fixation exte nt and of Gelling on La nd Hold ings (Am endm ent) Act, 192 commence- 1972. ment. It shall have the like extent as the principal Act. It shall come into force at once. Amend- 2. In Section 1 of the prin cipal Act, in sub-secment of Sec- ti on (2), after the word and punctua tio n " Lakhim-1 f 1 of pur," the word and pun ctuation " Di brug arh," shall p Iof'l9 5ACt inserted. In Section 2 of the princip al Act,— Amendmen t of Section 2 of Assam Act I of 1957. (1) Th e existing sub-clauses Nos. (b) and (c) (iii) shall be deleted and the existing sub-clauses (a), (c) (i), (c) (ii), (c) (iv), (c) (v) and (d) shall be re-num bered as sub-section (1), (2) (a), (2) (b), (2) (c), (2) (d) and (3) respectively. For the re-n umbered sub-clause (2) (b), substit ute the following: — " (2) (b). Lan ds exceeding 50 bighas, utilised for large-scale cultivation of citrus in a compact block by any person before the first day of Jan uar y, 1955”. For the re-num bered sub-clause (2) (c), substitute the following:— " (2) (c). Lan ds held by a mill, a factory, or a workshop, as may be req uired for the purposes of the expansion of th e mill 3 3 factory , or workshop, or for ancillary purposes of the mill, factory, worksho p, such as setting u p of schools, dispensaries, and road s, bu t not for any oth er purposes" . Lan ds held by a co-opera tive farming society for cultivation of sugar-cane, only for the purpose of feeding a co-operative sugar factory " . Th e explana tion at the end of the section shall be deleted. In Se ctions of the prin cipal Act,— in Cause (a), the punctua tion ( ; ) semiof 1957. colon at the end shall be sub stituted Toy the pun ctua tion ( , ) comma, and ther eafter the following shall be inserted, namely :— “arb oricul ture, piscicultu re, piggery, anim al husbandry, pou ltry and other allied pursuits ; ” clause (e) sh al l be deleted. in clause (f) the semi-colon at the end shall be deleted and the following shall be add ed, namely : — "and also includes lan d which is or may be utilised for quarryin g stones ; " in clause fk ),— (i) in sub-clause (iii) in between the words 'village" and "within" the words "o r tow n" shall be inserted. (ii) in the proviso, for the words " twenty-five" occurring in between the words "of" an d "years" the words "twenty-one" shall be substitu ted. Amendment 5. In Section 4 of the prin cipal Ac t,-— of Sec tion 4 of Assam Act I of (1) in sub-section (1),— (a) for the figure " 75" occurring in between the words " of" and " bighas" the figure " 50" shall be substituted. (b) in the proviso, for the figure " 30" occur= ring in between the words " of " and " bigh as" , the figure “ 15” shall be substitu ted. . (2) in sub-section (2),— (a) for the words “ this Act” the words “ the Assam Fixation of Ceiling on Land Holdings Assam Act (Amendm ent) Act, 1970" shall be substituted. VIII of
