(Received theassentoftheGovernoron28thApril,2016) THEARUNACHALPRADESHRIGHTTOPUBLICSERVICESACT,2016 (ACT NO.3 OF 2016) An Act toprovideforthedelivery of notifiedservicesto thegeneralpublicwithin thestipulated timelimit and for mattersconnected therewithand incidentalthereto; Whereas,itisexpedienttoprovideforthedeliveryofservicestothegeneralpublicwithin thestipulated time limit ; BeitenactedbytheLegislativeAssemblyofArunachalPradeshintheSixty-seventhYearofthe Republic of India.as follows,- 1.Short title and commencement :(1)This Act may be called the Arunachal Pradesh Right to PublicServicesAct,2016. (2)it shallextend to the whole of theState of ArunachalPradesh. (3)This Act shall apply to the Government Servants appointedsubstantively to any Civil Services or andAuthoritieswhichareowned,controlledorsubstantiallyfinancedbythatGovernment. (4)It shall come into force on such date as the State Government may.by notification in the Officiai Gazette,appoint. Definitions:-InthisAct,unlessthecontextotherwiserequires- (a) "Act"meanstheArunachalPradeshRighttoPublicServiceAct,2016: (b) "DesignatedOfficer"meansanofficerdesignatedassuchOfficerforprovidingservicesunder sub-section(2) of Section 4; (C) Section 4 :.: (d) "First angSecond Appellate Authority"meansofficerswho are designated as such Authority under Section 7; (e) "Government"meanstheGovernmentofArunachal Pradesh; (f) "Prescribed"meansprescribed by therulesmadeunderthisAct; (g) "Service"means any servicenotified underSection4; (h) "Local Body"means anyPublicAuthority,Municipal Body,Public SectorUndertaking,Corporation, Owned,controlledorsubstantiallyfinancedbytheGovernmentbywhatevernamecalled,forthetime beinginvestedbylawtorenderessentialservicesofPublicutilitywithintheterritoryofArunachal Pradeshorcontrol,manageorregulatesuchserviceswithinaspecifiedlocalareathereof; (i)"State"meansStateofArunachalPradesh; 3.Right to Services : (1) Subject to provisions of theAct, every eligible person in the State shall have a right toPublicServices. (2)The right referred to in sub-section (1) shall include the right to,- (a)have access to the public service ; (b)r receive thepublicservicewithin thespecified timelimit; (c) receive public service in a tansparent manner; dyGemandperformancebfdutiesand functionsinaccordancewith theAct; (f)seekcompensationwithrespecttonon-providingofserviceordeficiencyinservice. 4.Notification of PublicServicesand time limit':(1)The State Government or the Local body as andshallspecifythetimelimitwithinwhichsuchservicesshallbeprovidedtotheeligiblepersons. person. 5.Providing public service within specified time limit and Designated Officers:(1)It shallbe sub-section(1)ofSection4. (7)An appeal under sub-section (4) shall be disposed of within a period equiyalent to that of the stipulated time limit for delivery of service. (8)where the designated officer does not comply with the direction given by the first appeltate authority undersub-section(2)of thisSection,theperson aggrieved by such non-compliancemayfile an application to second appeal istobedisposedofunder thisAct. 7.Designation of Appellate Authorities:The Government may by notification designate the first AppelateAuthority and thesecond Appellate Authority in respect of eachpublicservice.TheLocal bodymay servicesrenderedbythesaidLocal body. Provided that thesecond Appellate Authority shall be anOfficeroutside the concerned department,who is higher in status to the First Appellate Authority. 8.Powersof Appellate Authorities:The firstAppellateAuthority and the secondAppellate Authority. whiledeciding anappeal undertheAct,shallhave thesamepowers as arevested inacivilcourtwhile trying a suit undertheCodeof Civilprocedure,1908(CentralActNo.5of1908)inrespectof thefollowing matters, namely:- (a)requiring the production and inspection of documents; (c)any other matter which maybe prescribed. 9.Penalty:(1)Where the second Appellate Authority finds that the designated officer has failed to writingstatingthereasons,imposeafineonthedesignatedofficerattherateof100(Rupeesonehundred) per dayforeach day's delay the sum of whichshall notexceed fivethousand rupees inthefirstoccasion,but thelimitof thefineshall notbeapplicableinsubsequent occasions: Provided that the designated officer shallbe givena reasonable opportunityof being heard before imposing such penaity. (2)where the second Appellate Authority finds that the first Appellate Authority has failed to decide the appealwithinthetimelimitspecified insub-section(3)ofSection6withoutsufficientandreasonablecause,he Provided that the first appellate authorityshall be given areasonableopportunityof beingheardbefore imposing such penalty. 10.Bar of jurisdiction of Civil Courts:No civil court shall entertain any suit, application or other awarded to the appellant as liability for delay; Section and the remaining amount will be deposited against the appropriate Head of Account as Government revenue. 12.Protection of action taken in good faith:No suit,prosecution or other legal proceedings shall underthisActoranyrulemadehereunder. 13.Power to make rules :(1)The Government may, by notification in the Government Gazette, makerulestocarryouttheprovisionsof theAct. (2)Everyrule made under thisAct shall,as soon as may be afterit is made,be laid before theArunachal PradeshLegislativeAssembly. locallyandonwebsitebytheSecretaryoftheDepartmentconcernedforinformationofthepublic 15.Power to remove difficulties : (1) If any difficulty arises in giving effect to the provisions of this Act, the State Government may, by orderpublished in the Official Gazette, make such provisions not inconsistent (2)EveryordermadeunderthisSectionshall,assoonasmaybeafteritismade,belaidbeforethe Arunachal Pradesh Legislative Assembly.
