(1) No offence punishable under this Act shall be tried by a court inferior to that of a Magistrate of the First Class.

38. (1) No offence punishable under this Act shall be tried by a court inferior to that of a Magistrate of the First Class. (2) No court shall take cognizance of any offence under this Act except on the complaint of the Director or Secretary or such other person as may be authorized by the Committee by resolution passed in this behalf.
