26 Presumptions and evidence In any prosecution under this Act- (a) any genetic material in or upon any place , premises , vehicle or vessel at the time a sample thereof is taken in terms of section 21 (3) (e) shall , unless the contrary is proved , be presumed to be in the same condition or to possess the same properties as such sample; (b) any statement or entry contained in any book or document kept by any person , or by the manager , agent or employee of such person , or found upon or in any premises occupied by , or any vehicle or vessel used in the business of any person , shall be admissible in evidence against such person as an admission of the facts set forth in that statement or entry , unless it is proved that such statement or entry was not made by such person , or by the manager , agent or employee of such person in the course of his or her work as manager or in the course of his or her agency or employment .
