If the owner fails without reasonable excusc
Proaedure in 39. (1) In cpse of any dispute between the hirer oaae of diepute and the driver of any hackney carriage, either may

require the other to proceed forthwith to the nearest and driver. magistrate's court ; and the then sitting magistrate shall hear and determine the dispute in e summary way.
If no ma!gistrate be then sitting, either party may require the other to proceed to the nearest police officer who shall enter the complaint in his diary and require the parties to appear before the magistrate at his next sitting.
On failure of either party to appear before the magistrate in pursuance of a requisition under sub-section (1) or sub-seetion (2) or to attend the court at any subsequent sitting to which the case may be adjourned, the magistrate may decide the case ex garte, and his decision shall bc binding on both parties.

If any person who has used any such carriage attempts to evade payment of the legal fare, or any portion thereof, he shall be liable to a fine not exceeding Hty rupees in addition to any payment which may have been ordered under sub-section (1).
