WHEREAS it is expedient to amend the Calcutta University Act, 1979, the North Bengal University Act, 1981. the Burdwan University Act, 1981, the Vidyasagar University Act, 1981, the Kalyani University Act, 1981, the West Bengal State University (Barasat, North 24-Parganas) Act, 2007, the Gour Banga University Act, 2007, the Sidho-Kanho-Birsha University Act, 2010, the Jadavpur University Act, 1981, the Rabindra Bharati University Act, 1981, the Netaji Subhas Open University Act, 1997, the Presidency University Act, 2010, the Coochbehar Panchanan Barma University Act, 2012, the Kazi Nazrul University Act, 2012, the Diamond Harbour Women's University Act, 2012 and the Bankura University Act, 2013, for the purposes and in the manner hereinafter appearing: It is hereby enacted in the Sixty-fifth Year of the Republic of India, by the Legislature of West Bengal, as follows:- West Ben. Act XXXVII of 2012. West Ben. Act XIX of 2013. Short title and commencement. Amendment of West Ben. Act, )(XXVIII of 1979. Amendment of West Ben. Act, XXV of 1981. 1. (1) This Act may be called the West Bengal University Laws (Amendment) Act, 2014. (2) It shall come into effect at once. 2. In the Calcutta University Act, 1979, for clause (c) of sub-Section (1) of Section 8, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— (i) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Senate: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". 3. In the North Bengal University Act, 1981, for clause (c) of sub-Section (1) of Section 9, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— (1) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; PART III] THE KOLKATA GALET lb, EXTRAORDINARY, SEPTEMBER 4, 2014 3 The West Bengal University Laws (Amendment) Act, 2014. (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Court: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". Amendment of West Ben. Act, XXIII of 1981. Amendment of West Ben. Act, XVIII of 1981. 4. In the Burdwan University Act, 1981, for clause (c) of sub-Section (1) of Section 9, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Court: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". 5. In the Vidyasagar University Act, 1981, for clause (c) of sub-Section (1) of Section 9, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Court: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". Amendment of West Ben. Act, XXVIII of 2007. Amendment of West Ben. Act, XXVI of 2007. 6. In the Kalyani University Act, 1981, for clause (c) of sub-Section (1) of Section 9, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— (i) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Court: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". 7. In the West Bengal State University (Barasat, North 24-Parganas) Act, 2007, for clause (c) of sub-Section (1) of Section 9, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— (i) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Court: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". 8. In the Gour Banga University Act, 2007, for clause (c) of sub-Section (1) of Section 9, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— (i) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Court: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". Amendment of West Ben. Act, XXIV of 1981. 9. In the Sidho-Kanho-Birsha University Act. 2010, for clause (c) of sub- Section (1) of Section 9, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— (i) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Court: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". 10. In the Jadavpur University Act, 1981. for clause (c) of sub-Section (1) of Section 9, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— (i) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Court: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". Amendment of West Ben. Act, XXXVI of 1981. 11. In the Rabindra Bharati University Act, 1981, for clause (c) of sub-Section (1) of Section 9, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— (i) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; 6 THE KOLKATA GAZET 1E, EXTRAORDINARY, SEPTEMBER 4, 2014 [PART. (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Court: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". Amendment of West Ben. Act, XIX of 1997. Amendment of West Ben. Act, XIII of 2010. 12. In the Netaji Subhas Open University Act, 1997, for clause (c) of sub- Section (1) of Section 10, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— (i) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Executive Council: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". 13. In the Presidency University Act, 2010, for clause (c) of sub-Section (1) of Section 8, the following clause shall be substituted:— " (e) The Search Committee shall be constituted in the following manner:— (i) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Governing Board: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". Amendment of West Ben. Act, XIX of 2012. Amendment of West Ben. Act, XXXVII of 2012. 14. In the Coochbehar Panchanan Barma University Act, 2012, for clause (c) of sub-Section (1) of Section 9, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— (i) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Court: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". 15. In the Kazi Nazrul University Act, 2012, for clause (c) of sub-Section (1) of Section 9, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— (i) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Court: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". 16. In the Diamond Harbour Women's University Act, 2012, for clause (c) of sub-Section (1) of Section 9, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— (i) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Court: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.". 8 THE KOLKATA GAZETTE, EXTRAORDINARY, SEPTEMBER 4, 2014 [PART III The West Bengal University Laws (Amendment) Act, 2014. In the Bankura University Act, 2013, for clause (c) of sub-Section (1) of Section 9, the following clause shall be substituted:— " (c) The Search Committee shall be constituted in the following manner:— (i) an academician, not below the rank of the Vice-Chancellor of a Central or State-aided University or the Director of a National institute of higher learning, to be nominated by the Chancellor in consultation with the Minister, and such nominee shall be the Chairperson of the Committee; (ii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the State Government; (iii) an academician, not below the rank of a Professor of a Central or State-aided University or National institute of higher learning, to be nominated by the Court: Provided that the nominees, as mentioned under sub-clauses (i), (ii) and (iii) shall not be the persons associated with the concerned University for which the Search Committee is constituted.".
