Page 1 of 2 Delhi Electricity Regulatory Commission Viniyamak Bhavan, C-Block, Shivalik, Malviya Nagar, New Delhi-110017 F.17(174)/DERC/Engg./17-18/5856 Order (Date of Order: 24.09.2018) Whereas the Delhi Electricity Regulatory Commission (Supply Code and Performance Standards) Regulations, 2017 (hereinafter referred to as ‘Regulations’) provides for temporary disconnection of supply on account of non-payment of dues. And whereas Regulation 19(6) of the Regulations provides for payment of fixed charges by the consumer during the period of temporary disconnection. And whereas Regulation 53 of the Regulations provides for disconnection of supply on the request of consumer. And whereas Regulation 54 of the Regulations provides for reconnection of supply on the request of consumer. And whereas, the consumers are facing difficulty for want of clarification whether the fixed charges are to be paid till the date removal of meter by distribution licensee where the premises has been sealed by concerned Municipal corporations or the electricity is disconnected by the distribution licensee on the Order of a Government Agency, where the consumer has no control. Now, therefore, the Delhi Electricity Regulatory Commission in exercise of its powers conferred under Regulation 85 of the Regulations, hereby makes this Order in respect of the provisions for levy of fixed charges, not inconsistent with provisions of the Act and the Regulations, to remove the difficulty, namely:- 1. Short Title & Commencement :- (1) This order shall be called Delhi Electricity Supply Code and Performance Standards (Removal of Difficulty) Third Order, 2018. (2) This order shall come into force on the date of its issue. 2. Disconnection or Reconnection of supply of premises sealed by concerned Municipal Corporation: (1) In case the premises is sealed by the concerned Municipal Corporation and consumer wants to avoid payment of fixed charges, it shall be obligatory on the consumer to inform the distribution licensee for permanent disconnection of supply. The distribution licensee may remove the service line and other equipment after disconnection of supply, whenever feasible. (2) Where the electricity is disconnected by distribution licensee on the Order of any Government agency authorized to do so and consumer wants to avoid Page 2 of 2 payment of fixed charges, it shall be obligatory on the consumer to inform the distribution licensee for permanent disconnection of supply. The distribution licensee may remove the service line and other equipment after disconnection of supply, whenever feasible. (3) Distribution Licensee shall levy fixed charges upto the date of intimation for permanent disconnection by the consumer. Thereafter, the connection shall be deemed to be permanently disconnected. (4) If the consumer comes for reconnection of the premises and service line and other equipment have not been removed by the distribution licensee, the connection shall be energized on payment of reconnection charges after clearing the past dues.
