(1) These rules may be called the Punjab Liquor License (First Amendment) Rules, 2010. (2) They shall come into force on and with effect from the date of their publication in the Official Gazette: 2. MARCHI 17,2010 618 (PHGN 26. 1931 SAKA) In addition to the aforesaid assessed [ee. an additional a8- seSsed fee @L the rate of rupees two per bulk litre, and a special assessed fee at the rate of rupees five per bulk litre on both light beer andl strong beeE shall also be levied at the stage of issue 0f permits to L-l Licepsees ' 8 Ink the said rules in Rule 35, for sub-Rule (2), the following shall be substitutedj namely; #(2) The Punjab Medium Liquor and Indian Made Foreign Liquor ivends shall be disposed of as Licensing Units. A Licensing Unit in urban areas shall consist of one L-J4A vend and one L-2 vend. In nural areas; u Licensing Unit may consislof single or multiple L-I4A vends, subjerl [D a maximum of five vends in Lne unit: One L-2 vend may also be adlded to ay of the aforesaid rural units; provided that the total license fee ofither unit is not less than Rs. 35 lac. The licensirig units shall be fprmed by the Collector with the approval of the Excise Commissioner; Punjab. The number of licensing upits in & group or zone shall be as under: In Municipal Cerportions Geographical zones consisting of of Amritsar; Jalaidhar and five 0 nine units Ludhiana In Municipal Corporations Unio group of seven units; Patiala and Bathind: In Disirict Headquiirters oiher than the Municipal Corporations (iv) In Sub-Divisipnal Headquaners, Municipal Commintees. Other than District Headquarters and Nagar Punchayats; and Uplo group of five units Uplo grup of four units Rural ureus Upto grnup of two units; Zenes will be allowed in places approved by Ilc Excise Commissioner, Ajgroup or ZO1e shall be formed by the Collector with the prior approval 04 the Excise Commissioner The license fee of a groupjor Zone shall be the sum total of the license fee, prescribed for each olfthejunits in that group or zone PUNJAB GOVT GAZ. (EXTRA:), MARCH 17,2010 619 (PHCN 26, 1931 SAKA) A person shall noi be allowed to submit more than five applica- tions per licensing uniti groupl zone in Corporation areas: However; in other urban areas, namely District Head Quarters, Sub- Divisional Head Quarters, Municipal Cummiltees, other than district Head Quarters and Nagar Panchayats, & persun shall not be allowed to file more than 30 applications irrespective of the number of licensing units Or groups in that area. Similarly, in Qural areas, the limit will be of 20 applications for each licensing unit OT groUp_ [Filis faund tlei applications have not been received for all the Units in a particular arez, the Excise and Taxation Commissioner may; if satisfied that a part alldlment of Units/ Groups zones in such area will adversely affectthe Slate revenue, or that it may impinge upon the smooth administration of Excise laws in such area, he may cancel the allotment procedure for that parlicular area. To facilitate the re-allotment of such units, the Excise and Taxaticn Commissioner may invite fresh applica- tions with or without reorganizing the groups. The groups Or zones may be enlarged at this stage to include all the Units in that location Or area 9_ In the said rules, in Rule 36, (a) for sub-Rule (2) the following sub-Rule shall be substituted, namely: "(2) The application formn for the grant of liquor vends shall be available in the office of the Assistant Excise and Taxation Commissioner (hereinafler referred t0 as AETC), In-charge of the district on payment of rupees ten thousand for single unit; If in an area, more than single unit is allotted on single application form, then the fee slruclure shall be as follows Group of two units Rs. 18000 (i5) Group of three units Rs_ 27000 (iii) Grokp of four units Rs. 36000 {iv) Group of five units Rs. 42000 (v) Group of six units Rs. 45000 (vi) Group of seven units and Rs. 5ooOO (vii) Zones within Corporation Rs. 50000 of Amritsar; Jalandhar and Ludhiana The fee shall nOt be refundable or adjustable. If the first or any subsequent allotmient procedure is cancelled by the department O, any 'application fomm is rejected by the department being invalid and not put to draw of lots, then the amiount of application fee will be PUNJAB GOVT GAZ. (EXTRA:), MARCH 17, 2010 620 (PHGN 26, 1931 SAKA) refunded I0 the doncerned applicant, after deducting rupees two thousand as processing fee. The entire proceeds from the sale of application forms Shall be utilized for the welfare 0 f scheduled castes [0 Meel tc ~experiditure on their pensions and shagun scheme. The application forms shall be serially numbered at three places, i. in the #pplication form, in the slip of draw of lots and on the receipt, issued to (he applicant (b) for sub-rules (6) and (14), the following sub-rules shall, respectively be subslituled _, namely 76) (2) A successful applicant shall be required to pay allotment fee immediately on Ine draw of his lot which shall be Rs 10.00 Lac per unit O growp or zone in the case of a Corpporation; and Rs: 5.00 Lac per unif or gTOup in District Head Quatters, and Rs. 2.00 Lac per unit or grOup in other areas This payment may be made by cash Or through demand draft banker'$ cheque, pay order or other pre paid Dank instruments: (b) The next draw shall be made after the first successful applicant deposits The amgunt of allotment fee due from Him: Failure to de- Posit allotmeni fce shall lead t0 disqualification &nd cancellation of allotment (14) The allotment fee charged in the above manner shall be adjusted jowards the fifteen per cenl; securty; which shall be recovered in the following manne" (j) five per cent within 48 hours of the draw f Jots; and (ii) ten per cent within 96 hours of the draw lots. (c) after sub-Rule (1 4 ) the following sub-Rule shall be inserted namely: (14-4) Notwithstanding anything contained in sub-rlle (14), the entire_ fifleeri per cent security shall have to be deposited by 3Ist day of March; in case Ihe period of forty-eight hours ninety-six hours, 85 thc caSc may be, is completed after the 31s day of March;; (d) in sub-Rule (16)| for the letters &nd figures "Rs: 135" the letters and figures "Rs, 146" shall be substituted PUNJAB GOVT GAZ (EXTRA.), MARCH 17,2010 621 (PHGN 26, 1931 SAKA) (e) in sub-Rule (28), for the words "The licensee shall be required to open his vend on the first day of April or within a period of one month from the commencemenl ofthe financial year; failing which his allotment shall be cancelled" , the following shall be substituted namely: "The licensee shall be required to open his vend on or before 1Sth day of April 2010. In Case he fails to do 80, the AETC of the district concered may extend the said period upto 3Oth day of April 2010 on payment of laie fce of Rs. 25,000/- in respect ofthe area falling within the jurisdiction of a Municipal Corporation, and Rs. 10,000/- in other areas_ f) in sub-Rule (30), in the proviso, for the figures *2009" the figures <2010" shall be substituted and (vi) for sub-rules (J8), (39)and (40}, the following sub-rules shall respectively} be substituted namely: "(38) 50 per cent of the total quota of PML shall be lifted by a L-I4A licenge From the distillery specified and allocated to him by the Excise Commissioner and the remaining 50 per cent of the quota, may be Iifited by him from any distillery of his choice; (39) A licensee shall also be allowed to liftadditional quota of both Punjab Medium Liquor and Indian Made Foreign Liquor to the extent of 10 per cent of the Iolal quota. This quota shall be allowed to be lifted at the endi 0f each quarter after the licensee has lifted full quola; In the first quarter; 25 per cent of the additional quota shall be given Rs. 8/- per PL for Punjab Medium Liquor and Rs. 10/- per PL for Indian Made Foreign Liquor: In the second quarter; the 20 per cent quota shall be allowed to be lifted at the afaresaid rates In the third quurtef, another 30 per cent quota shall be allowed to be lifted o te payment of Rs 6/- per PL 0 Punjab Medium Liquor and Rs. 8/- per PL on Indian Made Foreign Liquor: PUNJAB GOVT GAZ.
