EXTRAORDINARY PUBLISHED BY AUTHORITY No. 1078, CUTTACK, TUESDAY, JULY 8, 2014 / ASADHA 17, 1936 FISHERIES & ANIMAL RESOURCES DEVELOPMENT DEPARTMENT NOTIFICATION The 3rd July, 2014 S.R.O.No.277/2014— In exercise of the powers conferred by sub-Section (1) of Section 43 of the Prevention and Control of Infectious and Contagious Diseases in Animals Act, 2009, (27 of 2009) the Government of Odisha with prior approval of Central Government, hereby makes the following rules, namely:–– 1. Short Title and Commencement: (1) These rules may be called the Odisha Prevention and Control of Infectious and Contagious Diseases in Animals (Manner of Inspection of Check Post and Quarantine Camp) Rules, 2014. (2) They shall come into force on the date of their publication in the Odisha Gazette. 2. Definition: (1) In these rules, unless the context otherwise requires:— (a) ‘Act’ means the Prevention and Control of Infectious and Contagious Diseases in Animals Act, 2009; (b) ‘Animal Owner’ means a person who carries the animal; (c) ‘Department’ means the Fisheries & Animal Resources Development Department, Government of Odisha; (d) ‘Form’ means a form appended to these rules; and (e) ‘Identification’ means Act of identifying the animals by way of ear tagging, tattooing, mark by branding, photographs, microchips or any other suitable system; (f) ‘Section’ means a Section of the Act; (2) Words and expressions used in these rules and not defined but defined in the Act, shall have the same meaning as respectively assigned to them in the Act. 2 3. The manner of inspection and the period of detention at a Check Post or at a Quarantine Camp: (1) In order to ascertain whether the animal is infected with any of the scheduled disease, the animal stopped at the Check Post or detained in the Quarantine Camp shall be inspected by the Veterinarian in-charge of Check Post or Quarantine Camp for the following, namely:— (a) Movement and gait; (b) Dull, depressed, normal or excited behavior; (c) Increase in body temperature; (d) Ulcer in the mouth, feet or udder; (e) Excessive lacrimation, nasal or vaginal discharge; (f) Sweating and shivering; (g) Dryness of the skin, alopecia, skin rashes; (h) Weakness; (i) Bleeding through natural openings; or (j) Edema or swelling in dewlap region or any other part of the body. (2) The Veterinarian in-charge, of the Check Post or Quarantine Camp or staffs of the Department shall also collect the necessary samples for laboratory examination, if required. (3) The Veterinarian in-charge of Check Post or staff duly authorized for this purpose may detain animals at the Check Post for a period not exceeding 12 hours for the purpose of inspection, compulsory vaccination and the animal owner shall be given a vaccination certificate as prescribed under Section 9 of the Act. (4) After examination of the animal, the veterinarian or staff of the Department duly authorized for this purpose shall either allow entry of the animal to the controlled area or free area by issuing an Entry Permit in Form–A appended to these rules or shall direct to transport the animals to the Quarantine Camp. (5) The cost of examining, vaccinating, marking the animal, by branding, tattooing & eartagging or any other activity at the Check Post shall be fixed by the Director from time to time and shall be borne by the animal owner. 4. Form of permit to be granted by the Veterinarian in-charge of the Quarantine Camp or the staff of Department duly authorized for this purpose: (1) The Veterinarian in-charge of the Quarantine Camp or staff of the Department duly authorized for this purpose shall detain the animals which:– 3 (a)are suffering from any scheduled disease; (b)have come into contact with or have been kept in the proximity of animal infected with scheduled disease; or (c)have been transported by the in-charge Check Post as detailed in sub-Rule (4) of Rule 3 and the species of animals have been notified under Section 10 of the Act, and shall be subjected to a quarantine of 14 days in a Quarantine Camp. (2) The Veterinarian in-charge of Quarantine Camp or staff of the Department duly authorized for this purpose shall give an official acknowledgement to the animal owner or the person duly authorized by him, on his behalf for the animals detained in the Quarantine Camp which shall be in Form–B appended to these rules. (3) During quarantine, the animals shall be suitably given identification and shall be marked, examined for any scheduled disease and shall be vaccinated against the scheduled diseases and shall be provided with veterinary treatment, if required and after the animals are vaccinated, the animal owner or the person duly authorized by him on his behalf shall be provided with a vaccination certificate as prescribed under Section 9 of the Act. (4) After successful quarantine, the Veterinarian in-charge of Quarantine Camp or staff of the Department duly authorized for this purpose shall release the animals to the animal owner or person duly authorized by him on his behalf and grant the Quarantine Release Permit in Form-C appended to these rules under his signature. Form–C may also be used as Entry Permit as required by sub-Section (2) of Section 15 of the Act. (5) The cost of maintenance and vaccination of the animals during the quarantine shall be fixed by the Director from time to time and shall be borne by the animal owner. 5. Interpretation: If any question arises relating to the interpretation, construction or application of these rules, the same shall be referred to Government in Fisheries & Animal Resources Development Department, whose decisions thereon shall be final and binding.
