Short Title: 1. The Governor is pleased to make the following rules to raise and regulate a fund for giving compensation to the victims of Criminal offence, namely; i) These Rules may be called The Tripura Victim Compensation Fund Rules-200? ii) It extends to the whole of the State of Tripura. iii) It shall come into force at once. Definition: 2. In these Rules, unless the subject or context otherwise requires: a) 'Government' means Government of Tripura. b) 'Prison Administration' shall mean the 'Prison Administration' as defined in Bengal Jail Code c) 'Victim Compensation Fund' means the common fund created from the 20% of wages deducted from the prisoners employed in any work in a prison. d) 'Victim' means the person affected by the Criminal Act of the prisoner by loss of property etc. e) 'Victim Compensation' means the amount payable to the victim and in the case of the death of the victim, to his legal heirs. Payment 3. All payment of victim compensation may be paid from the Victim Compensation Fund (VCF) Victim Compensation Fund 4. (I) The VCF shall be credited into the Personal Deposit Account (PDA) opened for each person at the District level by the Supenntendent of Prison and a separate Personal Deposit Account f or the prison at the State level by the Inspector General of Pnsons towards disbursement of victim compensation (2) The VCF ava able in the PDA at the District level shall be transferred to the PDA at the State level once in three months or whenever necessary. (3) The VCF sha I consist of 20% of the wages deducted from the convicted prisoners and such other contribution/grants as the Central Government, State Government, any other organization or individual may make voluntarily. Committee: 5. (I) A two tier Comrn tee shall be formed one at the District Level and another at State level. (2) The District le e Committee shall consist of the following:- (a) District Collector (D. M) (b) Superintenden District Jail (c) Superintende t of Police (d) District Jailor -Chairman -Member- Secretary -Member -Member. (3) The State leve Committee shall consist of the followinq official member.s:- (a) Secretary to Government, Home (Jail) Department (b) Inspector General of Police(H Q) (c) Inspector General of Prisons -Chairman -Member -Member- Secretary Functions of District Level Committee: 6. The District Level Committee shall recommend the cases that are entitled for victim compensation to the State Level Committee with quantum of victim compensation 2 -- II!( ,()J IIIII~~I\(led together with the reasons thereof. Nature of Injury, loss of property, financial, IIU!llt;d ;111(1 other kind of sufferings, consequences therefore may be the factors for :1:,:,I~~;S"l~J and recommending compensation. i i he State Level Committee shall examine the recommendations of the District Level Committee and approve or disapprove the compensation recommended by the District Level Committee and may Increase or decrease the quantum recommended. 2.The State Level Committee may make recommendation to the Government of Tripura to amend or modify or add Rules for the proper maintenance of the Prison Fund. 3. During the period of impnsonment of a prisoner the victim of the offence committed by him, he or his legal heirs may be granted compensation from time to time. After approval of the quantum of victim compensation by the State Level Committee, it shall deduct the amount of victim compensation from the Prison Fund and send the order for disbursement of the amount to the Member Secretary of the State Level Committee, who shall disburse the victim compensation to the victim or in the case of the death of the victim to his legal heirs by Demand Draft under proper acknowledgement. Maintenance of Accounts: 9. The District Level COMmittee and the State Level Committee shall maintain necessary accounts for receipt and expenditure as per the financial procedure of the State Government. Audit of Accounts: 10. The accounts of the District Level Committee and the State Level Committee shall be audited by the internal audit and by the Accountant General By order of the Governor, B K. Ray.
