Criu*t Fire Prevention and Life Safety Measures Rules' 2014' AND WHEREAS circumstances exist which renders it necessary for the State Government to dispense with the po*., conferred by sub-Section (l) of Section 57 of the Gujarat Fire Prevention and Life Safety Measurqs Act,2013; NOW THEREFORE in exercise of the powers conferred by Section 57 of the Gujarat Fire prevention una r.ir.iur.tv rur"ur"tes Act,2013 read with Section 14 of the Gujarat Fire Preverition and Life Safety Measures (Amendment) ordinance, 2021 (Guj oid' No' 3 of 2021)' the . Government of Criurut herety makes the following rules further to amend the Gujarat Fire Prevention and Life Safety Measures Rules, 2014, namely:- l. (l) These rules may be called the Gujarat Fire Prevention and Life Safety Measures (Amendment) Rules, 2021' (2) They shall come into force on the date of their publication in the Official Gazette' z. In the Gujarat Fire prevention and Life Safety Measures Rules, 2014 (hereinafter referred to as ..the said Rules"), in Rule 2, fof sub-Rule (Z1,ttt" following sub-Rule shall be substituted' namely:- "(z)The words and expressions not defined in these rules but defined in the Act' or GDCR or National Building ioae or trraiu or relevant Indian Standards or Specifications published by Bureau of Indian standards shall have the meanings as assigned-to them in the Act or GDCR or National Building Code of India or relevant Indian Standards or Specifications published by thg Bureau of fttJia" Standards for construction and fire safety of buildings or premises and Pandals." 34-2 3. (1) (2) cUrennr covERNMENT GAZETTE, EX., 22-01-2021 I PART rV-B In the said Rules, for Rule 4, the following new Rule shall be substituted, namely:- u4, . Equipment and Appliances for Fire Service The Chief Fire Officer in Municipal Corporatirin area and the Director in other areas of the' State shall determine the requirement of equipment and appliances for rescue, firefighting, personal protection in such numbers and with such specifications taking into consideration ihe apprehension of fire risk in their area for offective measures of safety and efficient t.rpo*r in times of emergency. The Chief Fire Officer shall submit the report in this regard to the Director every year. The Chief Fire Officer in Municipal Corporation area and the Director in other areas of the State, with the previous sanction of the Government, shall procure equipment and appliances determined under sub-Rule (l) in such manner that each fire division is adequately equipped to meet with the requirement of fire-fighting and fire safety measures and make all necessary affangements for their upkeep and maintenance to ensure their availability to provide fire prevention and fire safety service as and when required. The life of equipment and appliances may be as per the recommendations of the Standing Fire AdvisoryCouncil of the Ministry of Home Affairs, Government of India or of any other authority as may be authorized by the Government for this purpose." In the said Rules, in Rule 5. - (i) for sub-Rule (1), the following new sub-Rule shall be substituted, namely:- "(l) The Chief Fire Officer in Municipal Corporation area and the Director in other . areas of the State, shall identify the area where the establishment of a fire station is tactically advantageous to provide fire prevention and life safety measure." (ii) for sub-Rule (4), the following new sub-Rule shallbe substituted, namely:- "(4) The composition of the fire station alongwith the staff pattern and facilities to be provided by a fire station may be decided by the Chief Fire Officer in Municipal .Corporation area.and the Director in other area, depending upon the circumstances prevailing and apprehension of fire risk in the area." In the said Rules, for Rule 9, the following new Rule shall be substituted, namely:- "9. Eligibility for Licensed Agency.-No person or association of persons shall be eligible to apply for grant of license to Act as a Licensed Agency unless he,- possesses atleast any of the following qualifications, namely:- (i) Bachelor's or Master's degree in Fire or Fire & Safety or Fire & Environment, Health and Safety; or Fire Engineering from a University established or incorporated by ait Act of the Parliament or a State Act in India or an educational institution declared as deemed to be a University under Section 3 of the University Grants Commission Act, 1956 (3 of 1956): or (iD Advanced Diploma or Diploma or Certificate in Fire Engineering conferred or awarded by the National Fire Service College, Ministry of Home Affairs, Government of india or by the Gujarat State Institute for Fire Safety Training (GSIFST), Government of Gujarat oi Uy the Gujarat Institute of Disaster Management (GIDM), Government of Gujarat; or (iii) Post Graduate Diploma or Post Diploma in Fire or Fire & Safety or Fire & Environment, Health & Safety; or Fire Engineering; or Industrial Safety or Industrial Safety &'Health from a University established or incorporated by an Act of the Parliament or a State Act in India or from an educational institution declared as deemed to be a University under Section 3 of the University Grants Commission Act, 1956 (3 of 1956); or (3) 4. 5. (a) 5*-i.4;'i, ' ,,(b).* (c) PART IV.B J GUJARAT GOVERNMENT GAZETTE, EX., 22.01.2027 34-3 (iv) Fellow (FIFireE) or Member (MIFireE) or Graduate (GIFireE) of the Institution of Fire Engineers (U.K.) or the Institution of Fire Engineers (India); and ,laas,.a,,{gg6ee i$r..Giv,i{.os Gheerrisal..or kfieehaniea,l,,sr Elestsioa.l.o.r Elestroa[e*-,-Engineering@,g-w- ..er..+::r;::.r* Aichitecture obtained from a University established or incorporated by an Act of the Parliament or a State Act in India or an educational institution declared as deemed to be a University under Section 3 of the University Grants Commission Act, 1956 (3 of 1956); and has during the period of 5 years immediately preceding the year of making application, experience of 3 years (2 years in case of having qualification mentioned in a(i)and (b)) in executing the work in relation to fire prevention, life safety and fire protection system; or holds a certificate of FSO specialist course awarded by the Gujarat State Institute for Fire Safety Training (GSIFST), Government of Gujarat; and has not been black-listed by any Government Department or authority established by a law of the State Legislature or any board or corporation or organization owned or controlled by the State Government or any other State Government." In the said Rules, for rules l0 and I I , the following rules shall be substituted, namely:- "10 Application for to Act as Licensed Agency.-(l) Any person or an association of persons who intend to Act as a Licensed Agency as specified under sub-Section (2) of Section 28 shall make an application in l'Form Al" for obtaining license. (2) The application made under sub Rule (l) shall be accompanied by fees as notified by the State Government from time to time. (3) The Applicant shall attach the following documents, namely:- (i) attested copy of partnership deed and power of attorney or arlicles of association and memorandum of association or affidavit on stamp paper in case the individual is the sole proprietor of the firni: (ii) certificates regarding satisfactory completion of works carried out for the required experience period. (iii) declaration regarding appointment of person fulfilling the requirement specified in clause (a) of Rule (9); (iv) attest'ed passport size photographs of partners or directors or individual proprietor and also of the professionals mentioned in clause (a) and (b) of Rule 9 referred to in the application; (v) affidavit on appropriate stamp paper, stating that hisi her firm is not black listed by any of the departments of the State Government, local authority or any board or corporation or organization owned or controlled by the State Government or any other State Government; (vi) address proof of office/ branch in Gujarat; (vii) list of technical staff with their qualifications; and (viii) such other information and/or documents as may be required by the Director. 11. License to Act as Licensed Agency.- The apptication made under Rule 10 shall be scrutinized by the Director in accordance with the rules and on being satisfied that the applicant fuIfills all the criteria for grant of license to work as Licensed Agency, he shall grant the T,icense in "Form-A2" to Act as Licensed Agency subject to the following terms and conditions, namely :- (d) 6. 34-4 GUJARAT GOVIRNMENT GAZETTE, EX., 22-O T.2O2I I PART IV-B (1) The licence shall be- (a) nbn-transferable, (b) valid for two year from the date of issue, unless suspended or cancelled' earlier, (c) renewable for period of two years, if so desired, before expiry of the licence. (2) Changes, if any, in resPect of (a) partners, director and/or members, (b) address of the offiee of the Licensed Agency, (3) The Licensed Agency shall always keep the work, executed or being executed by it, open for inspection by the Director or the Regional Fire Officer or Chief Fire Officer or any fire officer authorised.by the Director or the Regional Fire Officer or the Chief Fire Officer. (4) The Licensed Agency shall have office / branch in the State of Gujarat." In the said Rules, for Rule 14, the following new Rule shall be substituted, namely:- "14. Certificates to be issued by a licensed agency.- (l) A certificate regarding the compliance of the fire prevention, life safety and fire protection measures in a building or a part thereof as specified in the THIRD SCHEDULE, may be issued by a Licensed Agency in "Form-B1". (Z) During the period of validity of the Fire Safety Certificate i.e. from the date of issuance till the first renewal of the same, the Licensed Agency shall give an annual declaration in "Form-B2" stating that the fire prevention, life safety and fire protection measures provided in the building or premises are operational, in good repair and efficient condition as specified in sub-Section (2) of Section 29 of the Act. This declaration shall be submitted to the Regional Fire officer or the Chief Fire officer not later than 15 days every year on completion of first and second year from the date of issue of fire safety certificate." In the said Rules, for Rule 2l,the following new Rule shall be substituted, namely:- "21. Appointment of Fire Safety Officer.-(1) For the purpose of effective fire prevention, life safety and fire protection measures during the occupancy of the building and to get the fire safety certificate renewsd, every owner or occupier shall appoint a fire safety officer, two months prior to expiry of fire safety certificate issued under Section 21, having prescribed qualifications, experience and training and thereafter shall send the compliance repofi to that effect in "Form-B 1 1"to the Regional Fire Officer or the Chief Fire Officer. . (2) Fire safety off,rcer shall be enrolled by the Director after successful completion of the prescribed training dnd shall be issued the enrolment certificate in "Form-8I2". (3) In case of failure to appoint a fire safety officer as specified in sub-Rule (1), the Regional Fire Officer or the Chief Fire Officer shall, if it is considered to do so, communicate to the relevant authority to take appropriate action for the discontinuance of the use or clbsure of the building or premises or part thereof, as the case may be. (4) The ciassification of buildings or premises, the qualifications, experience, type of training and duties of different categories of the Fire Safety Officer shall be as specified in the FOURTH SCHEDULE." 8. It. 12. 13. PART rV-B l GUJARAT GOVERNMENT GAZETTE, EX., 22.01-2021 34-5 9. In the said Rules, in Rule 22,for sub-Rule (1), the following new sub-Rule shall be substituted, namely:- "(tr) ,. The rninimtm standards for fire.prevention, li e sa,fety and fire proteoti.en for buildings or premises required under sub-Section (2) of Section 18 of the Act, as provided in the GDCR or National Building Code of India, shall mutatis-mutandis apply in the following matters, namely: -" 10. In the said Rules, in sub-Rule 23, for sub-Rule (2\, the following new sub-Rule shall be substituted, namely:- *(2) The application for grant of Fire Safety Certificate shall be made to the Regional Fire Officer or the Chief Fire Officer in "Form-814" and shall be accompanied with a certificate from the Licensed Agency or architect on record or engineer on record or structural engineer on record and owner or occupiers to the effect that all the fire prevention, life safety and fire protection measures as required under Rule 22 have been incorporated in the building or premises." In the said Rules, for Rule 24, the following new Rule shall be substituted, namely:- "24. Duration of Fire Safety Certificate.-The fire safety certificate issued under Rule 23 unless sooner cancelled shall be valid for a period of3 years from the date ofissue: Provided that the Regional Fire Officer or the Chief Fire Officer, as the case may be, may reduce the period after recording the reasons thereof." In the said Rules, for Rule 25, the following new Rule shall be substituted, namely:- "25. Renewal of Fire Safety Certificate.- The Fire Safety Officer shall inspect the building or premises for which he is appointed under Rule 21, to verify the compliance of relevant rules and regulations and then issue a Fire Safety Certificate Renewal in "Form- 813.3" valid for a period of two years from the date of issue and for the same period thereafter.' In the said Rules. in Rule 26, (i) for sub-rules (l) and (2),the following new sub-rules shall be substituted, namely:- "(l) The owner or the occupier of the building or premises, as the case may be, shall maintain the fire prevention, life safety and fire protection measures provided in the building or premises at all times in best repairs for use by the occupants or members of Fire Service or both in the event of an outbreak of fire. (2) The owner or occupier of the building or premises and the Fire Safety Officer appointed under Section 12 of the Act, as the case may be, shall declare, after inspection every six months in "Fotm-815" that fire prevention, life safety and fire protection measures provided in the building or premises are operational, in place and in best repairs." (ii) after sub-Rule (4), the following new sub-Rule shall be added, namely:- "(5) In case of building or premises having more than one occupier, the association or the society of the occupiers shall be responsible for maintaining the fire safety measures as provided in the rules." 14. In the said Rules, in Rule 27, for sub-Rule (2), the following new sub-Rule shall be substituted, namelv:- *(2) The promoter, organizer or the owner or occupier shall be required to provide and maintain the measures specified in sub-Rule (1)." 34.6 GUJARAT GOVERNMENT GAZETTE, EX., 22-OI.2O2I I PART rV-B 15. In the said Rules, for Rule 32,the following new Rule shall be substitutedo namely:- "32. Training Charges.- The trainees including Fire Safety Officers, shall pay at the time of admissioR, training oharges as notified by the State Government, to the Prineipal, Gujarat State Institute for Fire Safety Training (GSIFST): Provided that, the trainees on the roll of State Fire Service shall not be liable to pay training charges." 16. In the said Rules, in Rule 37, for the words "after the institution of prosecution by the officer specified in column (2)", the words "after the institution of prosecution by the officer specified in column (l)" shall be substituted. 17. In the said Rules, for the FIRST SCHEDULE, the following schedule shall be substituted, namely:- FIRST SCHEDULE (See Rule 3) aualifications for the appointment of Nominated Officer 18. In the said Rules, in the SECOND SCHEDULE, - (i) in para l, in the Table,,in the entry at serial no.2, in column (2), for the words "Chief Fire Officer", the words "Regional Fire Officer / Chief Fire Officer" shall be substituted; (ii) in parc2, for sub-para(2),the following sub-para shall be substituted, namely:- "(2) The staff car used by the Regional Fire Officer or the Chief Fire Officer may display on the bonnet a flag made out of blue black blazer cloth and star plate on front and rear side bumper of the staff car as per drawing." lg. In the said Rules, for the existing THIRD SCHEDULE and FOURTH SCHEDULE, the following schedules shall be substituted, namely:- No person shall be eligible for the appointment as Nominated Officer unless he/she possesses atleast any of the following qualifications, namely:- (i) Bachelor's or Master's degree in Fire or Fire & Safety or Fire & Environment, Health & Safety; or Fire Engineering from a University established or incorporated by an Act of the Parliament or a State Act inlndia or an educational institution declared as deemed to be a University under Section 3 of the University Grants Commission Act 1956 (3 of 1956) with the experience of two years; or (ii) Advanced Diploma or Diploma or Certificate in Fire Engineering conferred orawarded by the National Fire Service College, Ministry of Home Affairs,Government of India or by the Gujarat State institute for Fire Safety Training(GSIFST), Government of Gujarat or by the Gujarat Institute of Disaster Management (GIDM), Government of Gujarat with the experience of threeyears: or (iii) Post Graduate Diploma or Post Diploma in Fire or Fire & Safety or Fire &Environment, Health & Safety; or Fire Engineeiing; or Industrial Safety or Industrial Safety & Health from a University established or incorporated by an Act of the Parliament or a State Act in India or an educational institution declared as deemed to be a University under Section 3. of the University Grants Commission Act 1956 (3 of 1956) with the experience of three years; or (iv) Fellow (FIFireE) or Member (MIFireE) or Graduate (GIFireE) of the Institution of Fire Engineers (U.K.) or the Institution of Fire Engineers (India) with the experience of three years. PART rV-B l GUJARAT GOVERNMENT GAZETTE, EX., 22-OT.2O2I 5THIRD SCHEDULE (see sub-Rule (1) of Rule 14) List of fiiuildings requiring fife safety certificat6'*-" Following is the list of buildings requiring fire safety certificate for compliance of the fire prevention, life safety and fire protection measures:- 34-7 (a) (b) All high rise buildings having height l5 m and above; and special buildings, those are, (1) hotel, educational, institutional, business, mercantile, storage, and mixed occupancies buildings, where any of these buildings area more than 500 m2 on any one or more floors; educational buildings having height of 9 m and above; institutional buildings having height of 9 m and above; all assembly buildings; all multilevel car parking: industrial buildings (ANNEXURE B of NBC-2016 Part 4); (i) Light Hazard - having height of l5 m and above (ii) Moderate hazard, - covered area more than 500 m2 (iii) High hazard - covered area more than 50 m2 all hazardous buildings; buildings, having area more that 300mr of incidental assembly on any floor; buildings with two basements or more, or with one basement of area more than 500 m2. hazardous have floor (2) (3) (4) (s) (6) (1) (8) occupancy (e) NOTE: 1) 2) 3) The definitions and terminology of the terms mentioned in this schedule shall be as per the NBC - 2016 (Part 4). Institutional buildings include hospitals, nursing homes, sanatoria, custodial, penal and mental instirutiohs with beds (with or without ICU). Industrial buildings having occupancy classified as light hazard as per ANNEXURE B of NBC-2016 (Part 4) below 15 m height of any floor area shall be covered under the provisions of the Factories Act, 1948 and the Rules made thereunder 4) Owner or occupiers of the building or premises not covered under this schedule are advised to provide fire fighting installations as mentioned in Table 7 of the NBC - 2016 (Part 4) in good faith and prdctice and maintain the same in operational conditions all time. 34-8 GUJARAT GOVERNMENT GAZETTE,8X.,22-At-2021 [ PART IV-B. FSO-A can also take up work of renewal of fire safety certificate for type of buildings mentioned against FSO-G. 4. FSO-S can also take up work of renewal of fire safety certificate for type of buildings mentioned against FSO-A and FSO-G 2. The duties of the fire safety officer shhll be:- 1. Issue fire safety certificate renewal upon compliance of all the mandatory requirements. 2. Give bi-annual declaration that fire prevention, life safety and fire protection measures provided in the building or premises are operational, in place and in efficient working condition. 3. Carr)' out bi-annual emergency mock drills and maintain record of the same.
