GOVERNMENT OF WEST BENGAL LAW DEPARTMENT Legislative NOTIFICATION No. 1332-L.-10th September, 2010.—The following Act of the West Bengal Legislature, having been assented to by the Governor, is hereby published for general information:— West Bengal Act XXII of 2010 THE BURDWAN UNIVERSITY (AMENDMENT) Act, 2010. [Passed by the West Bengal Legislature.] [Assent of the Governor was first published in the Kolkata Gazette, Extraordinary, of the 10th September, 2010.] An Act to amend the Burdwan University Act, 1981. WHEREAS it is expedient to amend the Burdwan University Act, 1981, for the purposes and in the manner hereinafter appearing; It is hereby enacted in the Sixty-first year of the Republic of India, by the Legislature of West Bengal, as follows:- West Ben. Act XXIII of 1981. Short title and commencement. 1. (1) This Act may be called the Burdwan University (Amendment) Act, 2010. Amendment of Section 3 of West Ben. Act XXIII of 1981. Amendment of Section 7. Amendment of Section 9. Insertion of new Section 9A after Section 9. 2. In sub-Section (1) of Section 3 of the Burdwan University Act, 1981 (hereinafter referred to as the principal Act), after the words "or the Vice-Chancellor", the words and brackets "or the Pro-Vice-Chancellor (Administration and Academic)" shall be inserted. 3. In Section 7 of the principal Act, after clause (i), the following clause shall be inserted:— "(ia) the Pro-Vice-Chancellor (Administration and Academic),". 4. In sub-Section (5) of Section 9 of the principal Act, for the words "the Chancellor in consultation with the Minister may appoint person to", the words and brackets "the Pro-Vice-Chancellor (Administration and Academic) shall" shall be substituted. 5. After Section 9 of the principal Act, the following Section shall be inserted:— 9A. (1) The Pro-Vice-Chancellor (Administration and Academic) shall be appointed by the Chancellor in consultation with the Minister and the Vice-Chancellor. The term of his office shall be for four years and he shall be eligible for re- appointment for a period not exceeding four years but shall not hold office beyond the age of 65 years. (2) The Pro-Vice-Chancellor (Administration and Academic) shall be a whole-time officer of the University and shall be paid from the University Fund such salary and allowances as the Chancellor may decide in consultation with the State Government. (3) The Pro-Vice-Chancellor (Administration and Academic) may resign his office by writing under his hand addressed to the Chancellor. (4) If— (a) the Pro-Vice-Chancellor (Administration and Academic) is, by reason of leave, illness or other cause, temporarily unable to exercise the powers and perform the duties of his office, or (b) a vacancy occurs in the office of the Pro-Vice-Chancellor (Administration and Academic) by reason of death, resignation or expiry of the term of his office, removal or otherwise, then, during the period of such temporary inability or pending the appointment of a Pro-Vice-Chancellor (Administration and Academic), as the case may be, the Chancellor, in consultation with the Minister and the Vice-Chancellor, shall authorize a Teacher of the University or an Officer of the University to exercise the powers and perform the duties of the Pro-Vice- Chancellor (Administration and Academic). (5) The vacancy in the office of the Pro-Vice-Chancellor (Administration and Academic) occurring by reason of death, resignation or expiry of term of his office, removal or otherwise shall be filled by the appointment of a Pro-Vice-Chancellor (Administration and Academic) in accordance with the provisions of sub-Section (1) within a period of six months from the date of occurrence of the vacancy.". Insertion of new Section 10A after Section 10. 6. After Section 10 of the principal Act, the following Section shall be inserted:— "Powers and 10A. (1) Subject to the supervision, direction and general duties of Pro- Vice-Chancellor control of the Vice-Chancellor, the Pro-Vice-Chancellor (Administration (Administration and Academic) shall be the chief academic and Academic). and administrative officer in all matters concerning the development and improvement of undergraduate studies and research and such other matters as may be delegated to him. (2) The Pro-Vice-Chancellor (Administration and Academic) shall, by virtue of his office, be a member of the Court, the Executive Council, the Faculty Council for Post-graduate Studies in Engineering and Technology, the Council for Undergraduate Studies in Engineering and Technology, the Council for Undergraduate Studies in Arts, Science, Commerce, Law, Fine Arts and Music and the Council for Undergraduate Studies in Medicine and such other committees of the University as may be required under the provisions of this Act or the Statutes. He shall also attend the meetings of the Faculty Council for Post-graduate Studies in Science and the Faculty Council for Post- graduate Studies in Arts, if the Vice-Chancellor considers it necessary. He shall preside over the meeting of the Faculty Council for Post-graduate Studies in Science and the Faculty Council for Post-graduate Studies in Arts, if the Vice-Chancellor is absent in such meeting. (3) The Pro-Vice-Chancellor (Administration and Academic) shall— (i) assist the Vice-Chancellor in the Academic Administration pertaining to Undergraduate Studies and research; (ii) suggest proper measures to be taken for efficient management of Undergraduate Studies and research and draw up specific scheme for their improvement and expansion; (iii) have the right to be present at and address any meeting of the academic bodies or committees relating to Undergraduate Studies or research of which he may not be a member but he shall not be entitled to vote thereat; (iv) have the power to convene any meeting of the Councils for Undergraduate Studies, the Boards of Undergraduate Studies or any other academic bodies or committees pertaining to Undergraduate Studies in case of any emergency; (v) assist the Vice-Chancellor in co-ordinating activities in respect of moderation of question papers pertaning to Post-graduate and Undergraduate examinations; (vi) assist the Vice-Chancellor in the academic administration pertaining to matters concerning the development and improvement of Post-graduate Studies in the Unversity and its affiliated colleges; (vii) assist the Vice-Chancellor for development of Central Library including the Information and Library Network Center; (viii) assist the Vice-Chancellor in maintaining the administration of funds and mobilization of resources; (ix) render necessary advice for preparation of annual budget, strengthening internal audit system, preparation of audit report and proper utilization of grants; (x) assist the Vice-Chancellor in liaisoning and collaborating with different Universities within and outside the country; (xi) perform such other duties as may be assigned to him by the Vice-Chancellor from time to time. 4 THE KOLKATA GAZETTE, EXTRAORDINARY, SEPTEMBER 10, 2010 [PART III The Burdwan University (Amendment) Act, 2010. (Sections 7-13.) Amendment of Section 17. Amendment of Section 20. Amendment of Section 22. Amendment of Section 24. Amendment of Section 26. Amendment of Section 28. Amendment of Section 54. (4) The Pro-Vice-Chancellor (Administration and Academic) shall exercise such other powers and perform such other duties for the development and improvement of all administrative and academic matters of the University as may be delegated to him by or under any provisions of this Act.". 7. In clause (a) of sub-Section (1) of Section 17 of the principal Act, after sub- clause (ii), the following sub-clause shall be inserted:— "(iia) the Pro-Vice-Chancellor (Administration and Academc);". 8. In sub-Section (1) of Section 20 of the principal Act, after clause (i), the following clause shall be inserted:— "(ia) the Pro-Vice-Chancellor (Administration and Academic);". 9. In sub-Section (3) of Section 22 of the principal Act, after clause (i), the following clause shall be inserted:— "(ia) the Pro-Vice-Chancellor (Administration and Academic);". 10. In Section 24 of the principal Act,— (1) in sub-Section (2), after clause (i), the following clause shall be inserted:— "(ia) the Pro-Vice-Chancellor (Administration and Academic);"; (2) in sub-Section (3), after clause (i), the following clause shall be inserted:— "(ia) the Pro-Vice-Chancellor (Administration and Academic);"; (3) in sub-Section (4), after clause (i), the following clause shall be inserted:— "(ia) the Pro-Vice-Chancellor (Administration and Academic);". 11. In Section 26 of the principal Act,— (1) for sub-Section (2), the following sub-Section shall be substituted:— "(2) The Dean shall be elected by the members of the Faculty Council for Post-graduate Studies from amongst themselves. The Dean of the Faculty Council for Post-graduate Studies in Science and the Dean of the Faculty Council for Post-graduate Studies in Arts shall be Vice-Chairman of the respective Faculty Councils."; (2) sub-Section (3) shall be ommitted. 12. In Section 28 of the principal Act, after the words "Vice-Chancellor as the Chairman", the words and brackets "and the Pro-Vice-Chancellor (Administration and Academic) as the Vice-Chairman" shall be inserted. 13. In sub-Section (1) of Section 54 of the principal Act, for the words "The Vice- Chancellor or, with the approval of the Vice-Chancellor, the Registrar may", the words and brackets "The Vice-Chancellor or, with the approval of the Vice-Chancellor, the Pro-Vice-Chancellor (Administration and Academic) or the Registrar may" shall be substituted.
