NOTIFICATION New Delhi,the 2Sth Febrary. 2009 GSR 25-_In exercise ofthe powers conferred by Section 56 ofthe Energy Conservation Act; 200| (52 ofz001) thc Central Government hereby makes the following rules, namely 1045 Fower 2009 1, Short title and commencement- (1) These riles may be called the Energy Conservation (Manner ofholding inquiry) Rules, 2009. (2) They shall come into force On the date of their publication in the Official Gazette. 2. Definitions - (1) In these rules, unless (hc context otherwise requires (a) "Act" means the Energy Conservation Act; 2001; (b) "adjudicating officer' means the adjudicating officer appointed under Section 27; (C) "section mcans section of thc Act; Words and expressions used herein and not defined but defined in the Act shall have the meanings respectively assigned t0 them in the Act Manner of holding inquiry by an adjudicating officer. Whenever the State Commission appoints an adjudicating officer, & copy of the appointment order shall be provided t0 the person conccmed In holding the inquiry, the adjudicating officer shall, issue # notice containing the particulars 0f violations under section 26 to the person concerned requiring him t0 appear before the adjudicating officer within twenty One days from the date of issue of such nolice. The adjudicating officer shall provide an opportunity to the concemed person to present his case. If the person concerned fails, neglects or refuses t0 appear before the adjudicating ofticcr as required under sub-rule (2), the adjudicating officer may procced with the inquiry in the absence of such person after rccording the reasons for so doing: The adjudicating officer; while bolding inquiry, shall follow as far aS possible the samc proccdure &$ is followed in the proceedings of the State Commis
