West Ben. Act LXII of 1978. 3 of 1956. GOVERNMENT OF WEST BENGAL LAW DEPARTMENT Legislative West Bengal Act XXVI of 1993 THE WEST BENGAL COLLEGE SERVICE COMMISSION (AMENDMENT) ACT, 1993. [Passed by the West Bengal Legislature.] [Assent of the President of India was first published in the Calcutta Gazette, Extraordinary of the 20th April, 1995.] [20th April, 1995.] An Act to amend the West Bengal College Service Commission Act, 1978. WHEREAS it is expedient to amend the West Bengal College Service Commission Act, 1978, for the purposes and in the manner hereinafter appearing; It is hereby enacted in the Forty-fourth Year of the Republic of India, by the Legislature of West Bengal, as follows:- 1. This Act may be called the West Bengal College Service Commission (Amendment) Act, 1993. 2. In section 2 of the West Bengal College Service Commission Act, 1978 (hereinafter referred to as the principal Act), after clause (h), the following clause shall be inserted:— `(hh) "institution deemed to be a University" means an institution declared as such by the Central Government under section 3 of the University Grants Commission Act, 1956;'. 3. In sub-section (1) of section 3 of the principal Act, for the words "five members", the words "seven members" shall be substituted. 4. After section 9 of the principal Act, the following section shall be inserted:-- 'Commission to hold eligibility test of persons before selection for appointment to posts of Lecturer in Universities and Colleges. 9A. (1) Notwithstanding anything contained elsewhere in this Act or in any other law for the time being in force or in any contract, custom or usage to the contrary, it shall be the duty of the Commission to hold, in such manner as may be provided for by regulations, eligibility test at State level o

1 · This Act may be called the West Bengal College Service Commission (Amendment) Act, 1993.
2 · In section 2 of the West Bengal College Service Commission Act, 1978 (hereinafter referred to as the principal Act), after clause (h), the following clause shall be inserted:—
3 · In sub-section (1) of section 3 of the principal Act, for the words "five members", the words "seven members" shall be substituted.
4 · After section 9 of the principal Act, the following section shall be inserted:--
9A · (1) Notwithstanding anything contained elsewhere in this Act or in any other law for the time being in force or in any contract, custom or usage to the contrary, it shall be the duty of the Commission to hold, in such manner as may be provided for by regulations, eligibility test at State level of persons, who are candidates for appointment to the posts of
6 · In section 15 of the principal Act, for the words "Nothing contained in this Act,", the words "Subject to the provisions of section 9A, nothing contained in this Act," shall be substituted.
