GOVERNMENT OF WEST BENGAL LAW DEPARTMENT Legislative NOTIFICATION No. 2186-L.--30th December, 2003.—The following Act of the West Bengal Legislature, having been assented to by the Governor is hereby published for general information :— West Bengal Act XXIX of 2003 THE WEST BENGAL APARTMENT OWNERSHIP (AMENDMENT) ACT, 2003. [Passed by the West Bengal Legislature.] (Assent of the Governor was, first published in the Kolkata Gazette, Extraordinary, of the 30th December, 2003.] An Act to amend the West Bengal Apartment Ownership Act, 1972, WHEREAS it is expedient to amend the West Bengal Apartment Ownership Act, 1972, for the purposes and in the manner hereinafter appearing; It is hereby enacted in the Fifty-fourth Year of the Republic of India, by the Legislature of West Bengal, as follows :— ( 1) This Act may be called the West Bengal Apartment Ownership (Amendment) Act, 2003. It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint. For sub-clause (ii) of clause (b) of sub-section (3) of section 4 of the West Bengal Apartment Ownership Act, 1972 (hereinafter referred to as the principal Act), the following sub-clause shall be substituted :- "(ii) execute and register an instrument in such form, accompanied by such fee, and in such manner and within such period as may be prescribed, undertaking to comply strictly with the bye-laws and with the covenants, conditions and restrictions as set forth in the Declaration referred to in section 1". 3.1n sub-section (1) of section 10 of thRule TOC
3 · 1n sub-section (1) of section 10 of the principal Act, for the words "The Declaration referred to in section 2 shall be submitted in such form and in such manner as may be prescribed", the words "The Declaration referred to in section 2 shall be submitted in such form, accompanied by such fee and in such manner as may be prescribed," shall be substituted.
