THE COMPANY SECRETARIES (ELECTION TO THE COUNCIL) RULES, 2006 [Issued by the Ministry of Company Affairs, Published in the Gazette of India, Extraordinary, Part II, Section 3(i) vide Notification No. GSR 533(E), dated 5th September, 2006 at New Delhi] In exercise of the powers conferred by Clause (a) of Sub-section (2) of Section 38A read with Clause (a) of Sub-section (2) of Section 9 of the Company Secretaries Act, 1980, the Central Government hereby makes the following rules, namely :— 1. Short title and commencement These Rules may be called the Company Secretaries (Election to the Council) Rules, 2006. They shall come into force on the date of their publication in the Official Gazette. 2. Definitions In these Rules, unless the context otherwise requires,— (a) "Act" means the Company Secretaries Act, 1980 (56 of 1980); (b) "Approved Form" means form approved by the Council for use for a specific purpose under these Rules: Provided that if any form has not yet been approved by the Council, after coming into force of these Rules, then the appropriate form laid down for the same purpose before coming into force of these Rules shall be the approved form; (c) "Returning Officer" means the Secretary of the Council appointed under Section 16 of the Act, or, in case the post of Secretary is vacant, any officer of the Institute designated by the Council for the purpose of conduct of elections. Words and expressions used but not defined in these Rules and defined in the Act shall have the same meaning as assigned to them in the Act. 3. Regional Constituencies For the purpose of constitution of the Council in pursuance of Clause (a) of Sub-section (2) of Section 9, the regional constituencies shall comprise of such States or Union Territories as listed out in Schedule 1 to the
