2 · As per Section 33() of the Rights of Persons with Disabilities Act; 2016 (Central Act 49 of 2016) "the appropriate Government shall identify posts in the establishments which can be held by respective category of persons with benchmark disabilities in respect of the vacancies reserved in accordance with the provisions of Section 34" of the said Act: 3_ In the Government order second read above, 263 posts under group A & B category were identified as suitable for differently abled persons under 3% reservation In the Government Order third read above Government have issued orders for increasing the percentage of reservation of differently abled persons in employment from 3% to 4% 4_ In the Government Order fifth read above, an Expert Committee for identifying Groups A'; B', 'C' and D' posts have been constituted as per Section 33() of the Rights of Persons with Disabilities Act; 2016. 5. In the Government Order fourth read above, in Group 'A' and 'B' categories three posts like Civil Judge and District Judge (entry level), Post Graduate Teacher and Physical Director (Grade-I) were identified, in the Government Order sixth read above certain amendment was made for the Civil Judge and District Judge (entry level) and in the Government Order seventh read above, Personal Assistant to Hon'ble High Court Judge, Interpreter and Senior system analyst were identified for most suitable for differently abled persons. 6_ In the letter eight read above, the State Commissioner for the Differently Abled has sent proposals for identifying posts suitable for differently abled persons under Group 'A' and 'B categories based on the opinion of the Expert Committee for consideration: 7 The Government after careful examination of the proposal of the State Commissioner for the Differently Abled, in consultation with all the concerned departments have decided to approve 229 posts under 'A' and 'B' categories and six posts already identified in Government orders Sth 6th and 7th read above_ Totally 235 posts under Group 'A' and 'B' categories are most suitable for differently abled persons. In respect of posts comes under other departments, boards and corporations will be identified and issue orders separately: 8_ The Government also direct that 4% of the vacancies in direct recruitment for the identified posts in 'A' and B Groups, where the rule of reservation is applicable for the SCs STs BCs and other communities, shall be reserved for the Differently Abled Persons_ If only one post is available for recruitment in these categories, the usual procedure for recruitment will be followed: The Government has also directed that; The reservation of 4% vacancies earmarked for the differently abled persons will be applicable to indentified posts in respect of 'A and B' categories for direct recruitment posts only The reservation of 4% vacancies for differently abled persons need not be made applicable in the case of recruitment by transferlpromotion as it would amount to giving double preference to these candidates_ (iii) If any department establishment is of the view that any particular post in 'A' and 'B' category is not suitable for differently abled persons, in such case, it may specifically request the Government for exemption: The administrative department in consultation with the State Commissioner for the Differently Abled and the Government shall issue appropriate orders_ (iv) The individuals selected for 'A' and 'B' categories of posts should be asked to produce certificate of physical fitness and the disability certificate as stated in Section 3(00) of Tamil Nadu Government Servants (Conditions of Service) Act, 2017
