GOVERNMENT QF PUNJAB DEPARTMENT OF LOCAL GOVERNMENT (Local Government 4 Branch) NOTIFICATION Tho Jrd March 2018 No5/11/2015-51g4/702470/1 In exercise of the powers conferred by sub section (I) of section 38 of the Street Vencors (Protection of Livelihood and Regulation of Strgel Verding} Act, 2014 (Central Act Nc 7 of 2014} and all othor powers enabling him in this behalf; the Governor oi Punjab, after ccnsultation wth the Iccal authorities an the Town Vending Committees in Ihe Slate of Punjab, is pleased to make the following scherre namely - SCHEME Short title and commencement This schema may be called "The Punjab Street Vendor $ (Protection of Livelincod and Regulalion of Street Vending) Scheme; 2016. 10 · Vending Foos (1) In order I0 meef the expenses for making arrangernent of land and CIvIc amenilies tho Local authorty shall charge the vending fee not more than the amount a8 specified against the classitication of the local uthorities guven below: For Corporation Cilies- Rs 10CO- Per month For Municipal Councils Class-1 Rs, BOO-Per mionth (T) For Municipal Councls Class-11 Rs. s0o-Per month (wv} Class-IIl and Nagar Panchayats Rs. 400/-Per month (2) Every year & minimum 5% increase In vending fees shall be imposed;
11 · Manner of collccting vending feos Every Iocal authority will collect vending fee by getting the cash receipt book printed under the head Street Vending Fee New bank account would BE opened afer follcwing praper procedure
13 · Relocation of street vendor (1) In case, & Iocal authority declares any arca or a part of any area as no vending zone for any public purpose, construction or development cf
14 · Manner of shifting of street vendors to an alternate site The Town Vending Committee shall bring the iSSue of shifting of street vendor to an alternale slte in it5 agenda and discuss the same tw months' prior to the issuance of onc month notice of shifting; 80 that a survey can be conducted lo Identify an oqually ideal vending site for the street vendors lo be relocated in the new vending zone 02) One month wrilten notice, prior to Ihie shifting the site, in lhe name of the street vendor shall be servod through registered post or may be served in person (31 In case the notice senl Ihrough registered post is received back undelivered, the said notice shall be pasted at & conspicuQu: place of the area where the street vendor is carrying on his vending and that shall be deemed io bo the proper service of the notice
15 · Manner of Eviction street vendor, who Is vending without certificate of vending or the certificale of vending has expired ad has not been renawed within sixty days after the date of its expiry Or whose cemiiicate of vending has beon cancelled, May be physicalll evicted from Ihe vending site by (he local authority: Provided that & prior nolice of thirty days giving the reasons for eviction, in Form specified In Annexure V, shall be served upon the street vendor in person befora his physical eviction
16 · Manner of seizure of goods (1) If the street vendor, after the expiry of period specified In tne notice for eviction given uncer para 15 fails l0 vacate the place of vending specified in the cerlificate of vending; and still continues to vend, the local authority May, beside his physical removal irom Ihe vending site, siege the gpods cf street vendor by deputing the official not below the rank of a superintendent duly authorized for such seizure (2) The authorized person to siege the goods shall prepare a list of such goods in duplicate and hand over the duplicate copy thereof duly signed by him lo the street vendor against prcper receipl wilh dale and may also indicate the tentative ten percent of the price of goods mentioned In tne sjid Iist 3s a fze for tha purpose oi reclaiming the goods by the street vendor 50 seized 17_ The Manner of reclalming seized goods 1) The street vendor whoso goods have been seized under para 16, may apply to reclaim it through an applicaticn addressed I0 Head of the local authority accompanied by the list of goods selzed along with the receipt cf fee specified in rule para {2) of tne said para fcr its reclamalion as Urder in the case ol perishable gojds on the same date on which such gonds are selzed: Provided that if stroot vendcr fails to reclaim Ihe perishable gcods on the game day; the Iocal aulhorily shall be al liberty to dispose of tne same by whatever manrer it deems fit and In the case ofnon- perishable goods within two wcrking days of its seizer (21 On recaipt of application of the Gtreet vendor Under mule para (1 the reclaimed good: shall be returned to him by the local authority against a propar receipl thereof
19 · Norms to be observed for upkeeping public health and hygiene The (ollowirg noms to eneure public health and hygiene shall be observed by local authority and the street vendors, namely the local authority of the concerned Area shall provide the vendors 2 proper place to dispose off thair waste materiais; the street vendors shall use proper covered dustbirs t0 dispose off the waste materials The used water shall aiso be disposed offin 3 Covered container; the local aulhority shall ensure a provide tha street vendors clean and fresh water alongwith the street light facility wherever it Is possible; and (iv) the Iocal authority shall provide ciean and properly constructed toilets with water and electricity facility near the streot vending strips .
20 · . State Nodal Offcer The Direclar Local Government; who Is Project Director of Punjab State Urban Livelihood Mission in the State, shall be lhe Nodal Oflicer for Co- ordination ol all mallers relaling io street vending at the State Level 21, Maintenance of propor rocords and other documonts (1) On-Iine goftware shall De developed by the Stale Govamment for keeping the ecords of Iha stroel vendon
2 · 5% of lhe population of a ward or zone shail be accommodated; the holding capacity of a vending zone will be according to tne vending Gite divided by the total area oi the vending area;
9 · walkway / footpath cf 1.0 /2 0 meters width shall be provided for pedestrians, in front of extension space depending on Ine road width; {iv) in no case the carriageway shall be allowed to be used for street vending; {vl IF the width of road permits, street vending may be allowed 0n bolh sides of the road; and (vib no vending activity shall be allowed at 0 distance of 50 meters Irom any junctionexiteniry of toad. 26. Principles of relocation The prirciples cf rclocation shall be subject to the followlng; namely -
