1 · . Short title and commencemcnt . -(I) These rules may be called the Prevention of Money Laundering (Appointment and Conditions of Service of Chairperson and Members of Appellate Trlbunal) Rules , 2007 .
2 · . Oetinitions . -(I) In these rules . un less the context otherwise requ ires,-
3 · . Qualifications for Appointment as Chairpcl ' son.A person shall not be qualified for appointment as Chairperson unless he is or has been a Judge of the Supreme Court or of a High Court or is qualified to be a Judge of the High Court .
4 · Method of Appointment as Chairpcrson .-The appointment of Chairperson shall be made on the recommendation of the Chief Justice of India , *
5 · . Qualifications for Appointment as Member . -(I) The Accountant Member will be from the following category-
6 · . Method of Appointment as Member . -(1) ** Selection shall be made on the recommendation of a Selection Committee comprising of-
7 · , Appointment of Chairpersou and One Member of an existing Appellate Tribunal . -The Chairperson or a Member holding a post as such in any other Tribunal , established under any taw for the time being in force, in addition to his being a Chairperson or a Member of that Tribunal, may be appointed as Chairperson or Member. as the case may be , of Appellate Tribunal .
8 · Salary, allowance , etc. of the Chait ' l)crson . -(I) A serving Judge of the Supreme Court or of High Court appointed as Chairperson shall be entitled 10 a monthly salary at rhe same rate as is adm issiblc to him as a judge of the Supreme Court or of a High Court . as the case may be and he shall be entitled to such allowances and other bene Ills as are admissible LO a judge of the Supreme Court or of a High Court, as the case may be .
9 · . Salary , allowances , etc. of mcmbcrs . -(1) A Judge of the High Court appointed as member shall be entitled to a monthly salary at the same rate as is admissible to him as a judge of the High Court and he shall be entitled to such allowances and other benefits as are admissible to ajudge of the High Court .
10 · . Fixation of IJay of member . -Where a person retired from service under the Government or any local body or authority owned or controlled by the Government appointed as member , his salary as member after such retirement shall be reduced by the amount of pension and pension equivalent of any other form of retirement benefits .
11 · . Provident Fund .-(I) The Chairperson. if he is a sitting Judge of the Supreme Court or of a High Court , shall be entitled to make contributions towards General Provident Fund Account under the General Provident Fund (Central Services) Rules, 1960. in the same manner as any other Central Government servant .
12 · . Traveling allowances.(1) lfthe Chairperson is a serving Judge or a retired Judge of the Supreme Court or of a High Court , he shall be entitled to draw traveling allowance u nder the Supreme Court Judges (Traveling Allowance) Rules . 1959 , or as the case may be , the High Court Judges (Traveling Allowance) Rules , 1956, in respect of journeys performed by him in connection with the work of the Tribunal at the rates as are admissible to a Judge of the Supreme Court or of a High Court, as the case may be. However , a retired Judge of the Supreme Court or of a High Court shall not be entitled to the benefit of higher daily allowance admissible to a serving Judge of the Supreme Court or of a Higher Court , as the case may be , for performing functions outside their nominal duties in localities away from their headquarters .
14 · Vaeatiou.« (1) Where the Chairperson is a serving Judge. he shall be entitled to vacation in accordance with the Supreme Court Judges (Salaries and Conditions of Service) Act . 1951> (4l of 1958), or as the case may be the High Court Judges (Salaries and Conditions of Service) Act, 1954 (28 of 1954) ,
15 · . Accommodation, -(1) A serving Judge or a retired Judge of the Supreme Court or of a Hjgh Court who is appointed as Chairperson shall be entitled . w ithout payment of rent , to the use of an official residence in accordance with Supreme Court Judges (Salaries and Conditions of Services) ACl, 1958 (41 of 1958), or as the case may be, the High Court Judges (Salaries and Conditions of Service) Act , 1954 (28 of . 1954) ,
16 · . Medical attcudancc ,-(I) A serving Judge or retired Judge of the Supreme COUl1 or of a Higb Court shall be entitled to medical attendance in accordance with the Supreme Court Judges (Salaries and Conditions of Service) Act . 1958 (41 of 1(58) , or as the case may be High Court Judges (Salaries and Conditions of Service) Act, 1954 (28 of 1954) ,
17 · Teuure .-(J) Chairperson ' -(a) Where a serving Judge of the Supreme Court or of a High Court is appointed as Chairperson, he shall hold office as Chairperson for a period of five years or till he attains the age of seventy years or sixty-seven years , as the case may be , w hichever happens earlier:
18 · . Other Conditions of Service> The conditions of service of Chairperson and members in respect of matters for which no provision is made in these rules shall be the same as may for the time being be applicable to other officers of the Central Government of a corresponding status .
19 · Power ' to Relax . -Where the Central Government is of the opinion that it is necessary or expedient so to do. it may by order for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.
20 · . Saving . -In respect of any matter not covered by these rules , the Chairperson and a member shall be governed by such rules or orders as may be applicable to a Central Government Officer of equivalent status .
21 · . IntcrprdaHon . -If any question arises relating to the interpretation of rule , the matter shall be referred to the Central Government who shall decide the same .
