14 · 47 97, #T fri, &F #al &R %aeut 4r m7 7v4 164 %tMT # To fy 190 # 4fve-2 # vefafKr 3ev %f 4T Hfhfa % KrR4 #} 3j4 81 [Y7, #, 30/9/2005-(siq. 3(v) ] # &4/ , 7TR &eq NOTTICATION New Delhi, tbe 27th September; 2006 G.SR 598(E).-~In exercise ofthe powers conferred by clauses (a) and (d) of Sub-section (2) read with Sub-section (1) of Section 75 ofthe Disaster Management Act;; 2005 (53 of 2005), the Central Government hereby makes the following rules, namely 1, Short title and commencement _(1) These rules may be called the Disaster Management (Term of Office and Conditions of Service of Members of the National Authority and Payment of Allowances to Members of Advisory Committee) Rules; 2006. (2) They shall come into force on the date of their 'publication in the Official Gazette. 2. Definitions _ (1) In these rules, unless the context otherwise requires, "Act" means the Disaster Management Act; 2005 (53 of2005); (6) advisory committee" means the advisory committee constituted by the National Authority under Sub-gection (1) of Section 7; (c) Smember"' means member of the National Authority nominated by the Chairperson of the National Authority under clause () of Sub-section (2) 0f Section 3; Ssection" means & section of the Act; ~Vice-Chairperson_ means the Vice - Chairperson designated by the Chairperson of the National Authority under sub-section (3) of Section 3. (2) Words and expressions used herein and not defined in these rules but defined in the Act shall have the meanings respectively assigned to them in the Act 3. Pay and service conditions (1) A person nominated as & mlember"of the National Authority shall exercise his option to chobse either; (a) Pay (less: pension in the case of retired officer), dearness allwance, accommodation; medical facilities, travelling allowance, leave travel concession as admissible to a' Secretary to the Government of Indja and Jeeve aS admissible to a Government servant under the Central Civil Services (Leave) Rules, 1972; or (6) pay, daily allowance as admissible to a Union Minister of State ad pension (without dearess relief in the case of retired officer); accommodation, medical facilities, travelling allowance as admissible to a Union Minister of State in accordance with the provision of the Ministers (Allowances, Medical Treatinent and Other Privileges) Rules, 19S7,made under the Salaries and Allowances ofMinisters Act;
1952 · (58 of 1952), andleave &s admissible to a temporary Government servant under. the Central Civil Services (Leave) Rules, 1972 , but without the facility of leave travel concession Provided that the option once exercised shall be final. A member of the National Authority; who js designated as the Vice-Chairperson of the National Authority under Sub-section (3) of Section 3, shall be entitled to pay and daily allowance, as admissible to a Union Minister; who is a member of the Cabinet, and pension (witbout dearness relief) and in the case of member who is retired officer, accommodation, medical facilities and travelling allowance &s admissible to & Union Cabinet Minister in accordance with the provisions of the Ministers (Allowances, Medical Treatment and Other Privileges) Rules; 1957,made under the Salaries and Allowances of Ministers Act 1952 (58of 1952) Disqualifications: No person shallbe a member of the National Authority, who (a) is, or at any tirne has been, adjudged insolvent; or (6) is declared to be of unsound mind by competent court; or (c) becomes incapable of acting 85 a member; or (d) is, or has been convicted ofan offence which; in the opinion of tbe Central Govemment; involves moral turpitude. (e) is, or has been removed or dismissed from the service of the Government or a body corporate owicd or controlled by the Government; 5 Reslgnation _ Any member of the National Authority may resign from the office of member of the National Authority by giving & notice in writing under his hand to that effect to the Chairperson of the National Authority ad such resignation shall take effect from the date on which guch notice is accepted by the Chairperson of the National Authority: 6. Vacancies _ Where a vacancy occurs in the office of a member of the National Authority by reason of resignation, disqualification, death Or otherwise, the vacancy may be filled by fresh nomination: 7.Albwances to bepaid t0a member of the Advisory Committee constituted by the National Authority __ member ofthe Advisory Committee constituted under Sub- section '(1} of Section 7 shall be paid such trevelling allowances, roOm rent; daily allowances and conveyance allowance as are admissible to &member ofthe High Power Committee as specified in Appendix-2 to Supplementary Rule 19, [F No.30/9/200S-NDM II(A)] NAVEEN VERMA, Jt.
