Rule TOC
2 · . Definitions : -In these rules , unless the context otherwise requires ,
3 · . Office ofthe Council: -TheOffice oftheCouncil shall be situated in the StateCapital , either at Naharlagun or at Itanagar. r.
4 · . The powers , and duties of the Council shall include -
5 · . (I) Time and Place of the Council Meetings :- The meetings ofthe Council shall ordinarily be held at State Capital Complex either at Naharlagun or at Itanagar or at such other places and on such dates an d time as may be decided by the Council. Provided the President may call a special meeting at any time after giving 15 days ' notice on a special requisition made by the Secretary of the Council: otherwise State Council shall meet at least once in three months of every year at its office atsuch time as may be appointed by the Council under sub-section (9) of section 4 ofthe Act.
6 · . (I) Agenda Papers :- The Secretary shall issue with the notice ofthe meeting an agenda paper showing the business to be brought before the meeting , the terms of all motions to be moved of which notice in writing has previously reached him and the names ofthe movers .
7 · . (I) Attendance of the meeting : At each meeting , an attendance register shall be placed in the meeting room and every member present shall sign against his / her name in the Register .
8 · . Conduct of business of meetings :- Every meeting of the Council shall be presided over by the President or ifhe is absent , by the Vice-President or if both ofthem are absent , by a Chairperson to be elected by the members present from among themselves .
9 · . Quorum :- 50% oftotal number ofthe members of the Council shall form a quorum . If, at the time appointed for a meeting; a quorum is not present , the meeting shall not commence until a quorum is present the meeting shall stand adjourned to such future time and date as the President may appoint.
10 · . (I) Voting on motions :- Every matter to be determined by the Council shall be determined on a motion moved by a member and put to the Council by the President.
12 · . (l) Adjournment ofmeeting:-When ameeting is adjourned to a future day , the Secretary shall informthe members in the meeting by announcing .
13 · . ( 1) Minutes of the Meetings:- A copy oftheminutes of each meeting shall be submitted to thePresident and after his attestation the same shall be circulated to the Council members immediately thereafter .
14 · . Approval of written proposal by circulation :- Whenever it appears necessary to thePresident to consider a proposal by circulation , he may , instead of convening a meeting , direct the Registrar to circulate awritten proposal for the observations and votes of the members of the Council and then decide on the basis of maj ajority .
15 · . Power to appoint Committee and Sub-Committee:-The Councilmay , ifso desires appointCommittees/ Sub -Committees to carry out such functions of the Council as may be entrusted .
16 · . Powers and duties of thePresident: -The President shall exercise such powers and perform such duties as prescribed/ conferred under theAct and standing orders ofthe Council. He/she shall actsuch as he/she considers necessary in furtherance ofthe objects for which the Council is established . In case of urgency the President may take the necessary action and intimate the fact to the next Council meeting .
17 · . Vice- President: -Ifthe office ofthe President is vacant or thePresident for any reason is unableto exercise the powers or perform the duties of his/ her office, e, the ViceePresident shall act in his/ her place and shall exercise the powers and perform the duties ofthe President.
18 · . Resignation:- The President may at any time resign his/ her office by a notice in writing addressed to the Council and delivered to the Registrar . The resignation shall take effect from the date on which it is accepted by the Council or on the expiry of60 days from the date ofthe delivery ofthe notice whichever event occurs earlier .
19 · . Filling up of Casual vacancy:When a casual vacancy occurs by reason of death or resignation of a member , a report shall be made forthwith by the President to the State Government who shall take steps to have the vacancy filled for the remaining period by nomination or election as the case may be; by the Authority .
20 · . Registrar/ Secretary:-
22 · . (1) Appointments :- Tillsuch time asregular employees are appointed, theCouncil shall engage/ appoint suitable number of ministerial as well as lower grade Group " D " staffon contract basis or on ad -hoc basis or on any other suitable terms and conditions under sub-section (I) and sub-section (2) of section 5 ofthe Act.
23 · . (1) Banker :- TheCouncil shall have an account in the local branch of any one ofthe nationalized banks e . g . State Bank oflndia, Central Bank oflndia, United Bank oflndia etc. c. All funds oftheCouncil shall be deposited into the Council account with the Bank. k.
24 · . Preparation of Register:-
25 · . How to Register :- Any Person who possesses recognised medical qualification(s) under sub-section ( I) (a) ofsection 2 oftheAct shall apply to the Registrar in Form-I, accompanied by:

Special cases for registration of foreign degree holders: (I) No person who possesses a medical qualification granted by any authority in any place outside the territory of India (other than the qualification specified in the Second Schedule or the Third Schedule ofthe Indian Medical Council Act , 1956) , shall be registered under theCouncil , u nless the procedure specified in thesub-rule (2) has been fulfilled .
27 · . Display of certificate ofregistration :Everyregistered practitioner shall begiven a certificateofregistration in Formm2 which shall be valid for a period of five years from the date of registration . The registered practitioner shall display the certificate ofregistration in a conspicuous part in the place ofhis/ her practice and nd if he/she has more than one such places , in any one ofthem .
28 · . Validity ofthe Registration & Renewal : · TheRegistration Certificate shall be valid for only five years from date ofregistration and thereafter the same is renewable by applying in a prescribed Form-3 .
29 · . (I) Publication of List of Registered Practitioners :- (i)After having prepared theregister of all medical practitioners in accordancewith Rule 24 , 25 & 26 , theRegistrarshall causeto be printed and published in the Official Gazette and in such news papers the council may select , the first correct list of all persons for the time being entered in the register .
30 · . Provisional registration:
32 · . Falsely claiming to be registered as Medical Practitioner: Ifany person whosename is notfor thetime being entered in the register , falsely represents that it is so entered , or uses in connection with his/her name or title any words or letters reasonably calculated to suggestthat his/her name isso entered, he/she shall , on conviction , be punishablewith fine which may extend to Rs . 5000/-/-(Rupees five thousand) or imprisonment up to 1 (one) month or with both .

Professional Conduct , Etiquette and Ethics :- Each applicant, t, atthe time ofmaking anapplicationforregistration under the provisions ofthe Act, t, shall be provideda copy ofthe Indian Medical Council (ProfessionalConduct, t, Etiquette andEthics) , 2002 (whichmay be modified by the Medical Council ofIndia from time to time) , andshall duly submit a dulysignedDeclaration as provided in Appendiy-C , The applicantshall also certify that he /she has read and agreed to abide by the same .
