ORDER: Article 16(4A) of the Constitution a5 amended by Ihe Constilution (Eighly Fifth Amendment) Act; 2001 reads &s follows: 16(4A}: Nothing in this article shall prcvent tlic Slate frorn making any provision for reservation in matters of prornolion, with consequential seniority, to any class or classes of posts in the services under the State in) {avour of the Scheduled Castes and Scheduled Tribcs which, in thc opinion ol the State, are not adequately represented in the service under lhe State" 2 The said Amendment to the Constitution has been made ivith an objective of makking a provision for reservation in matter of promotion with consequential seniority to any class or claisses of posfs in the services under (he State in favour of Scheduled Castes and Scheduled Tribes which in the opinion of thc State, are not adeguately represented in the service under the State: 3.
