1 · Sbort ttk u4d Coramenceneat-(1) This order may be calked the Tea (Marketing) Control Ordet, 2003. (2) It shall come into force on the date ofits publication in the Official Gazette:

3 · Registration of manufacturer 0f tea (1) No manufacturer shall carry o the activities of manufacturing tea after sixty days of the publication of this order in the Official Gazette except under a valid registration obtained under this Order in respect of each factory owned Or controlled by him:

4 · Regbtration of buyer of tea +(1) No person shall caty on the activities of buying tea from any public tea auction Iiensed by Tea Board or directly from manufacturer of tea after Sixty days of the publication of this order in the Offiial Gazette except under a vald registration obtained under this Order;

6 · Cancellation/ Suspension of registration of Buyer (1) The Registering Authority may, after gi ving the buyer an Opportunity of being heard, cancel or suspend the Registration on any one or mo 're of the following grounds, namely

7 · Monttk Returs (1) Every registered manufacturer shall fumish t0 the Registering Authority a monthly return in Form 'E' ard such other information a8 the Registering Authority may, by special Or generel order call for from time t0 time.

8 · Meiateaanee ef Reoerd (1) Every Registered Manufacturer engaged in purchasing tea leaves from other growerg shall maintain records as determined by the Registering Authority fom time to time &d sall fumish t0 the Officer authorised by Registering Authority all such iformation as the authorised ofier may by special Or general Order call fr fOm tim t0 time.

9 · Organber of Tea Auction to obtah #cence - No organiser of tea auction shall carry 0n the business Of organising, bokling Or conducting publc tea auctions under its control or auspices except uder a kcence dbtained in accordance with the provisions of this Order:

10 · Broker in tea Auction to obtain licence No person shall carry on the business of a broker of tea in public tea auctions except under a licerce obtained in accordarce with the provisions of this Order:

11 · . Application for Licence Every application for & licence referred to in paragraphs 9 ad 10 shall be submitted to the Licensing Authority in Form *G'_

12 · Grant er Refusal of licence - (1)The Licensing Authority may, for reasons to be recorded in writing; refuse to issue a licence to an applicant and shall furnish him with a copy of the order s passed: Provided that before passing an order of refusal an opportunity of being heard shall also be granted to the applicant.

13 · Issue of direction- (1) The Licensing Authority at any time during the valid period of licence may issue directins to the organiser of tea auctionsbbrokers either individually or collctively

14 · Period of validity of licence - A licence isSued uder this Order shall unless cancelkd before, expire On the 31 day ofDecember of the calendar year.

15 · Renewal of licence - (1) Every aplcation for remewal thereof by broker Or organiser f auctions shall be submitted to the Liensing Authority in For T; The Licensing Authority may; on a application made to it and subject to the other provisions ofthis Order; renew a licence and issue & certificate in Form *J; (3) Every application for renewal of & Ecence shall be submitted to the licensing authority: not Jess than thirty days before the date of expiry of the Icerce except in cases where the licence bas been issued on Or after 1# day - ofDecember ofthat calendar Year:

16 · Signlng of bicence RRegistration Every licence issued O renewed and every certificate of registration granted under this Order shall be signed by the Licensing Authority or the Registering Authority, 9S the case may be, or by any oficer of the Board specifically authorised to do s by the Licensing AuthoritylRegistering Authority:

18 · Conditiom of Ficcnce (I) Every Icence issuod'0r Iewed udkr tbis Order shall be deemed to bave been granted Or Tenewed in favour of the pereon named therein and no licence shall be sold Or otterwise transfented; (2) If & lxensee enters into a partnershi with regud to tbe businees covered by his lcence; he ghall bring tbe matter t0 the notie of thc Liensing Authority within ffecn days of entering into such partnership and shall get the kxence suitebly ancndd; Wheze & partnership is entered into, all tbe partners in tbe fim &8 well a8 the original Iixensee shall & bour] by tbe conditions ofthe licance; If 0 partnership is dissolved, every perzon wto is & partncr imediately before the date of such dissolution shall snd a report of axh dissolution to the Licensing Authority within ffteen days thereof; (5) Every Icensee ghall produce his Iicenee for inspection 0n demand by an offcer of the Board duly authorised by the Licensing Authority m this bchale; (6) IE during te currency ofa licence; te Ixxnsee inteuds to teke any action which calls for modifications in the particulars furnished i the application on the basis of which te #icence for t time being in force has been issued, be shall bring to the notice of the Liccnsing Authority &t least' ffteen days in advance a0 get his Icence autably anakd &x ach amendment to tke licerce shall be made fee of any charge a0d the aneided bar sall be valid for tho Iest of the period covered by the licence; (7) No owner of a warehouse licensed undker the Tca Warchousing (Licensing) Order; 1989 shall enter into any transaction with; (a) a manufacturerlbuyer who is required to be registered under this Order; but has not So registered, or whose registration has ceased to b val Or a broker Or organiser of & public tea auctin wto is Tequied to obtain & licerce uxder this Orcler but has not done $0, Or whose licence has ceased to be valid.

19 · Cancclbtion/Susperasian of a Licence -(1) The] Liensing Authority may, after giving: a licensee (organiser of tea auction/broker) an opportunity of" being beard, cancel Or suspend & Icence on any One Or more oftke follwing grounds, namely

20 · Maintepance, Submission of accounts, etc by licensee ~The Registering AuthoritylLicensing Authority mays from time to time issue directions t0 any registered manufacturer, registered buyer; licensed organiser of tea auctiong, broker as Tegards:- (a) the maintenarxe of records of production purchaselsale, stocks exports or other matters connected with his business which are relevant for purposes of carrying out the objects of this Order; the form and manner in which such records shall be maintained and the submission for inspection t0 the officer concerned such books of account relating to his business a8 may be specified m the direction

21 · Sale of tea tbrough publx anctions (1) Every registered manufacturer, as specifed by a direction of the Registering Authority, shall from tbe date of commencernent of this Order, sell such percentage a8 my be specifed from time t0 time by the Registering Authority, of tea manufactured by him in a calender year Or such period as may be specified in the direction through public tea auctions in India hek under the control or auspices of organisers of tea auction licensed to do s under the provisions of this Order:

22 · Purchase of Tea by Buyer (1) Every registered buyer shal on and fom tbe date of commencement of this Order; buy such percentage of his total purchase of tee aS may be directed from time to time by te Registering Authority in any calendar year through public tea auctions in India

23 · Sak of Tea ontside pubhc auction Every registered manufacturer who sells teas outside the auction system #all do s0 only t0 registered buyers and details of such sale shall be intimated to the Registering Authority within fifteen Working days- of the conclusion ofsuch sale:

24 · Appeal - Any - person aggrieved by a order (a) refusing the grant or cancellinglsuspending of egistration; refysing the issue Or renewal ofa licence; Or carellinglsuspending a licence,

25 · Constitution of committee Op tea marketing ~ The Central Government may by mtifiation in the Ofiixial Gazette constitute a Committee from time to time to advise the Central Government on matters relating to the implementation of this Order and may refer any question relating there to for the Committee' $ advice:

26 · Service of orders and directions (1) Any order Or direction made by tbe Registering Authority or Licensing Authority under this Order shall either be notified in the Official Gazette or be served on individuaVCompany or ay other entity viz , organiser of tea auction, tea broker; manufacturer of tea , buyer of tea etc;;

27 · Power ofEntry etc - The Registering Authority the Licensing Authority Or any officer of tbe Board specifically authorised in this behalf in writing by the authority, may enter and search at any time any Jand . uiling; premiscs Or vehicks i wtich the Registering Authorityl Licensing Authority has Ieason to believe that tea is stored carried distributed or sold in contravention ofthe provisions of this Orer ad scize any tea Or product of tea which appears to him to be stored carried distributed Or sol i contravention of the provisions of this Order;

28 · Adherence to the Standard of Tea by mapufacturerabuyers (1) No manufacturer shall manufacture tea whih does not conform to specifcation as laid down under the Prevention of Food Adulteration Act 1954 as amended fom time to time Or any Other rules for the time being in force

29 · Drawing of Sempk The Licensing Authority/Registering Authority may authorise a offcer of the Board not below the rank of Executive Director @ take any sampk of not more than 125 grams in weight per set in 3 sets, duly sealed and signed by the said officer and the representatives of the owner concered and any other two witnesses ,draw fom any stock held by the manufacturer/buyer to check whether the sample taken confors t0 specifxations as laid down under the Prevention of Food Adulteration Act 1954 as amended fom time t0 time Or any other ruks for the time being in force.

30 · Determination of Reasonabk Price and its compliance - (1) Whenever consiered necessary, any officer specially empowered by the Registering Authority, shall determine the reasonable price oftea leaves payable to the tea growers on a peridical basis;

31 · Delegation of Powers of the Registering/Licensing Authority The Registering Licensing Authority may, by special order, delegate any of his function to one Or more officers of the Tea Board with (he prior approval of the Central Government:
