RAJASTHAN AIR (PREVENTION & CONTROL OF POLLUTION) RULES, 1983. G.S.R: 59 _ In exercise of the powers conferred by section 54 of the Air (Prevention and Control of Pollution) Act, 1981 (Central Act 14 of 1981),the State Government after consultation with the State Board for the Prevention and Control of Water Pollution, hereby makes the following rules; namely CHAPTER Preliminary 1. Short Title and Commencement (1) These rules may be called the Rajasthan Air (Prevention and Control of Pollution) Rules, 1983. (2) These shall come into force on the date of their publication in the Official Gazette. 2 Definitions In these rules, unless the context otherwise requires "Act" means the Air (Prevention and Control of Pollution) Act, 1981 (Central Act 14 of 1981); b "Form' means a form annexed to these rules; C_ "Section" means the section of the Act; d. Omitted Worlds and expressions used but not defined in these rules and defined in the Air (Prevention and Control of Pollution) Act, 1981 (Central Act 14 of 1981) shall have the meaning respectively assigned to them in that Act. CHAPTER 2 Manner of Declaration Of Air Pollution Control Area 3_ Manner of declaration of any area or areas within the State as air pollution control area or areas Any area or areas within the State may be declared as air pollution control area or areas either by reference to map or by reference to the boundry of any district or by reference to the circumference or boundry of the industry specified in the schedule or partly by one method and party by another. 13 · Qualification for government or State board analyst A person shall not be qualified for appointment or recognised as a government analyst or a board analyst as the case may be under subsection (1) of section (2) of section 29 of the act unless he is a (1) Graduate in science from a recognised University with five year experience in laboratory engaged in environmental investigation testing or analysis or (2) post graduate in science or exit in engineering or a graduate in medicine or equivalent with 2 years experience in a laboratory engage in environmental investigation testing or analysis or (3) post graduate in environmental science from recognised University with two year experience in a laboratory engage in environment investigation testing or analysis"3
14 · Memorandum of Appeal (1) Any person aggrieved by an order made by the State Board under sections 20,21 or 22 may file an appeal to the Appellate Authority constituted by the State Government in Form VI.

The state Board shall issue consent to establish for a period of 5 years' In case Project Proponent requires extension in validity then a request for the same should be made at least four months before the expiry of validity tf consent to establish along with reasons for the same: In case Project Proponent fails to apply for extension four months before the expiry of validity of consent then fresh consent application along with requisite fees will have to be submitted for extension in validity of consent'
8 · That in the Case of quarry licenses up to 1.0 hectares, Only obtaining of acknowledgment as per sub-rule (7) of rule 29, is sufficient subject to compliance of Environment impact Assessment Notification,2006, as amended
