Punjab Restaurant (Consumption of Liquor) Rules , 1955 Published vide Punjab Notification No . 4618 -E&T -55 -1224(CH) dated 5th November 1955 1 . Short title : -These rules may be called the Punjab Restaurant (Consumption of Liquor) Rules , 1955 . 2 . Definitions : -In these rules unless the context otherwise requires [(a) ' restaurant ' means any place to which the public is admitted for consumption of food or drink for a consideration and includes I have attached to a retail country liquor vend] [and a retail foreign liquor vend] (b) " proprietor " means the proprietor of a restaurant and includes any occupier thereof defined in sub -section (10) of section 3 of the Punjab Municipal Act , (III of 1911); [(c) ' Licenced restaurant ' means a restaurant which has been licensed under these rules]; (d) ' Licencee ' means any proprietor of a restaurant licensed under these rules; (dd) ' Form ' means a form appended to these rules] . (e) " country liquor " means country liquor as defined in the Punjab Excise Liquor Definitions , 1954 . (f) " foreign liquor " means foreign liquor as defined in the Punjab Excise Liquor Definitions , 1954 . [3 . No person shall keep or have in his possession country liquor or foreign liquor in any quantity on any premises used as a restaurant in any of the places enumerated in the Appendix to these rules where under sub-section (4) of section 24 of the Punjab Excise Act , 1914 (Punjab Act of 1914) , the consumption of liquor in a restaurant has been prohibited by the State Government by notification or in any other place in regard to which a similar notification may have issued or may subsequently be issued by the State Government , unless such premises have been licensed for consumption of liquor under the said Act or rules made thereunder;]

1 · . Short title : -These rules may be called the Punjab Restaurant (Consumption of Liquor) Rules , 1955 .
2 · . Definitions : -In these rules unless the context otherwise requires
4 · . The number of [licensed restaurants] for consumption of liquor in any particular area shall be fixed by the State Government in consultation with the Financial Commissioner .
5 · . Subject to the other provisions of the rules and subject to the conditions specified therein , a licence in Form L -52 may be granted by the Collector concerned for a period of one year from 1st April to 31st March on payment of fixed fee of -
6 · . [License in form L-52] shall not be granted in respect of premises which are suspected of being visited by minors , students , bad characters , criminals or prostitutes .
7 · . [A licence may be cancelled or suspended by the Collector for breach of any of the conditions of that licence :
8 · . A licence shall not be utilised in respect of any premises other than those in respect of which it has been granted .
9 · . [Licenced premises] shall at all times be open to inspection by all excise officers of and above the rank of excise officers of the second class .
1 · . The licensee shall not sell or supply any kin of liquor to consumers .
2 · . The licensee shall kept his restaurant well ventilated , adequately and nicely furnished , thoroughly clean and dry . The restaurant shall be situated in a proper building having pacca floors . The entrance shall be fitted with a door which would close automatically . The furniture shall also be so arranged that passers by do not have any view of its interior .
3 · . The licensee shall not permit any singing , dancing or theatrical performance or entertainment in the restaurant as to cause any disorderly conduct in his restaurant and disturbance to neighbours of the restaurant .
4 · . The licensee shall observe dry days and shall not permit the consumption of liquor at his restaurant except at following hours :-
5 · . The Collector may order the temporary closure of restaurant for preservation of public peace and make any change in the above hours according to the conditions prevailing in the area concerned .
6 · . This license is not transferable and may be cancelled/suspended by the Collector concerned at any time without assigning any reason .
