West Ben. Act XIII of 1979. GOVERNMENT OF WEST BENGAL LEGISLATIVE DEPARTMENT West Bengal Act XXXVIII of 1981 THE WEST BENGAL TOWN AND COUNTRY (PLANNING AND DEVELOPMENT) (AMENDMENT) ACT, 1981. [Passed by the West Bengal Legislature.] [Assent of the Governor was first published in the Calcutta Gazette, Extraordinary, of the 23rd November, 1981.] [23rd November, 1981.] An Act to amend the West Bengal Town and Country (Planning and Development) Act, 1979. WHEREAS it is expedient to amend the West Bengal Town and Country (Planning and Developinent) Act, 1979, for the purpose and in the manner hereinafter appearing; It is hereby enacted in the Thirty-second Year of the Republic of India, by the Legislature of West Bengal, as follows:- This Act may be called the West Bengal Town and Country (Planning and Development) (Amendment) Act, 1981. In section 19 of the West Bengal Town and Country (Planning and Development) Act, 1979, in clause (d) of sub-section (1), after the existing proviso, the following further proviso shall be inserted:— "Provided further that on the revocation of the order of supersession of the Corporation of Calcutta os a municipality, as the case may be, the members nominated by the State Government under the first proviso to this clause in place of the Councillors or the Commissioners, as the case may be, shall, notwithstanding that the term of office of such members has not expired, cease to hold office as such members and the vacancies shall be filled up by the State Government by making fresh nominations from amongst the elected Councillors or the Commissidners, as .the case may be.".
