Act VI of 1982. GOVERNMENT OF WEST BENGAL LAW DEPARTMENT Legislative West Bengal Act IV of 1993 THE WEST BENGAL TAXATION LAWS (AMENDMENT) ACT, 1993. [Passed by the West Bengal Legislature.] [Assent of the Governor was first published in the Calcutta Gazette, Extraordinary, of the 7th April, 1993.] [7th April, 1993.] An Act to amemd the Bengal Excise Act, 1909, the Bengal Amusements Tax Act, 1922, the Bengal Electricity Duty Act, 1935, the Bengal Finance (Sales Tax) Act, 1941, the West Bengal Primary Education Act, 1973, the West Bengal Motor Spirit Sales Tax Act, 1974, the West Bengal Urban Land Taxation Act, 1976, the West Bengal Rural Employment and Production Act, 1976 and the West Bengal Entertainment-cum-Amusement Tax Act, 1982. WHEREAS it is expedient to amend the Bengal Excise Act, 1909, the Bengal Amusements Tax Act, 1922, the Bengal Electricity Duty Act, 1935, the. Bengal Finance (Sales Tax) Act, 1941, the West Bengal Primary Education Act, 1973, the West Bengal Motor Spirit Sales Tax Act, 1974, the West Bengal Urban Land Taxation Act, 1976, the West Bengal Rural Employment and Production Act, 1976 and the West Bengal Entertainment-cum-Amusement Tax Act, 1982, for the purposes and in the manner hereinafter appearing; It is hereby enacted in the Forty-fourth Year of the Republic of India, by the Legislature of West Bengal, as follows:- (1) This Act may be called the West Bengal Taxation Laws (Amendment) Act, 1993. Short title and commence- ment. Amendment of Ben. Act V of 1909. (Section 2.) It shall be deemed to have come into force on the 1st day of February, 1993.

3 · In the Bengal Amusements Tax Act, 1922, in section 3, after sub-section (3b), the following sub-sections shall be inserted:—

6E · (1) Notwithstanding anything contained in section 10 or any rules made thereunder or any term of a contract to the contrary, any person responsible for paying any sum to any dealer for execution of a works contract referred to in section 6D wholly or partly in pursuance of a contract between such dealer and—
