3 · Eligible Educational Institutionsʊ Employees of teaching and non-teaching categories of the following Educational Institutions notified as Aided Educational Institutions under clause (b) of Section 3 of the Act who have not received Grant-in-Aid or Block Grant shall only be eligible for consideration for receiving Block Grant for its employees if they have been appointed in accordance with the yardstick prevalent during the time of their appointment and after following due procedure for appointment in the posts which are admissible to such educational institutions, namely: ʊ
4 · Admissibility of the Block Grantʊ Employees of the categories mentioned in Para-3 appointed prior to imposition of ban on recruitment by the Higher Education Department vide letter No.18074/HE., dated the 20th April 1998 shall be entitled to receive Grant-in-Aid by way of block grant determined in the manner provided in Para 5 :
5 · Rate and disbursement of Block Grant tʊ (1) The Block Grant payable to the employees of the Aided Educational Institutions under Para. 4 shall be a fixed sum of Grant-in-Aid, which shall be determined by taking into account the initial of the basic pay at the prerevised time scale of pay plus 7 increments plus Dearness Allowance at the rate of 41 percent as on the 1st day of January, 2004 of the teaching & non-teaching employees of the Aided Educational Institution, who have not received Grant-in-Aid or Block Grant, but the determination of the quantum of such Block Grant shall be within the limits of economic capacity of Government as mentioned in sub-section (1) of section 7-C of the Act and shall have no linkage with the salary and allowances payable to any such employee by the Governing Body, from time to time.
6 · Scrutiny of the proposal for sanction of Block Grantʊ (1) On verification of the records of the concerned Aided Educational Institution by the Committee constituted for the purpose, the result of verification will be furnished to the Director in the prescribed format as at Annexure-I, II and III to this Order.
7 · Non-application of this Order to certain Educational Institutions ʊ Notwithstanding anything contained in Para. 3, no Educational Institution which has not been notified as Aided Educational institution under clause (b) of section 3 of the Act shall be eligible to receive Block Grant for any post (s) from the Government under this Order:
8 · Recovery of payment made on the basis of incorrect, false or concealed informationʊ Where an Order is made by the Government or the Director for approval of any post to receive Block Grant on the basis of incorrect, false or concealed information of the authorities of any Aided Educational Institution, such Order shall be liable to be cancelled or modified and any payment already made in that connection shall be liable to be recovered from the employee concerned or the Governing Body out of the funds of the concerned Educational Institution.
9 · Interpretation ʊ If any question arises relating to the interpretation of any of the provision of this Order, it shall be referred to the Government for decision, which shall be final and binding.
10 · Removal of doubts and difficulties ʊ For removal of doubts and difficulties the Government may issue such general or special instruction, not inconsistent with the provisions of the Act or of this Order, as may be considered necessary.
