DRAFT RECIPROCAL TRANSPORT AGREEMENT BETWEEN JARKHANAND WEST BENGAL: Notification 24 January, 2003 In the terms of provisions under sub-section (5) of section 88 of the Motor Vehicle Act, 1988 (Act 59 of 1988), the Governor is hereby pleased to publish the draft Reciprocal Transport Agreement which the State of West Bengal and Jharkhand propose to enter into, for information, of all likely to be effected thereby. Draft Reciprocal Transport Agreement _between the State of_West Bengal and Jharkhand 2002 Whereas with a view to encouraging the movement of Transport Vehicles on inter-state routes between West Bengal and Jharkhand, regulating and controlling their operation, providing facilities to travelling public and infrastructural support for the growth of industry and trade and also creating scope of employment; it is necessary to enter into Reciprocal Transport Agreement: Now, therefore, the Govt. of West Bengal and Govt. of Jharkhand hereby enter into a draft Reciprocal Transport Agreement on the terms and conditions as set out herein below. For the purpose of ready reference the name of routes, number of permits on each route agreed upon have been shown in Annexures. Annexure A is in respect of the existing routes which were included in the agreement of 1988 between Bihar and West Bengal. However the number of permits stand modified as agreed upon. The new routes are shown in Annexure 'B'. The list of the routes lying between West Bengal and Bihar and passing through Jharkhand is shown under annexure 'C'. The extended agreed routes including quota of permit are shown under Annexure 'D'. This Reciprocal Transport Agreement shall be valid till it is replaced by another agreement by mutual consent for reasons to be given in writing by either of the State Governments. Th

1 · TAXATION(A) Permits issued under the provisions of this Agreement shall be subject to the provisions of the Act; Rules and Regulations providing for taxes/fees as may be in force from time to time in the reciprocating state. There shall be double point motor vehicles tax in respect of all categories of transport vehicles covered by the arrangement of Inter-state reciprocal Transport Agreement between the State of West Bengal and Jharkhand. This double point taxation will be applicable even during pendency of renewal, if substantive permit under section 87 of the M: V. Act; 1988 is issued under the agreed route and countersigned by the other state. (iii) The Transport Authority of Home State granting permit of stage carriages, contract carriages and goods carriages shall assist the recovery of taxes and arrears of reciprocating state in all possible ways. (iv) At the time of renewal, replacement of the vehicle Or surrender of Inter-state permits, the receipt of payment of taxes of the reciprocating state shall be verified by the permit granting state So that either of the state may not lose tax revenue. Taxes payable in respect of temporary permits O special permits shall be collected at the entry point of the reciprocating state or at the point where the reciprocating state may decide.
2 · SATAGE CARRIAGE a) As agreed upon;, in the Reciprocal Transport Agreement in regard to the Inter-state stage carriage permit 0n the inter-state routes and number of permits allocated to each state against the routes have been fixed as far as practicable on the basis of length of the alignment of the routes falling in each state. b) That the routes mentioned in the Annexures indicate, the routes alongwith total number of permits allocated to each state as agreed upon under the agreement: That any discrepancy discovered latter in the distance shown in the said Annexure(s) shall be promptly corrected through correspondence between the two State Transport Authorities and shall not be treated as modification of the agreement The change of alignment of route(s) not exceeding 24 Km;, in either of the reciprocating states shall be similarly dealt with: That the temporary stage carriage permits issued uls 87() (c) of the M V. Act; 1988, pursuant to this draft Reciprocal Transport Agreement; prior to the final publication of this Draft Agreement uls 88(6) of the M.V. Act; 1988 shall be countersigned by the states in accordance with the provision of law. The time-table of every service shall be fixed by the permit issuing State, avoiding clash of timings of other operators, subject to the approval of the reciprocating state. f) The initial time-table shall be fixed by permit issuing State 0n & purely provisional basis to be valid for 2 (two) or 3 (three) months and which is to be countersigned by the reciprocating State. The provisional time-table will be final after the expiry of provisional period or meeting the objection(s) if filed any. It is agreed upon between the two states that a Single permit with 4 (four) trips per day (2 ups X 2 downs) may be granted where length of the route is upto 100 kms. and single permit with 2 (two) trips

5 · GOODS CARRIAGE (Permanent Permits):- a) The public carriers permits for 1000 vehicles shall be countersigned by the State Transport Authority of either of the State. The countersignature shall be valid for the National and State Highways with a deviation not exceeding 50 kms. from these roads to reach manufacturing concerns Or industrial centres.
