1 · Short lille and commencement- (1) These regulations may be called the Bureau of Energy Efficiency (Parliculars and Manner of their Display on Labels o Room Air Conditioners) Regulalions, 2009_

3 · Particulars to be displayed on lhe labels: (1) On every room air condilioner; the following parliculars shall be displayed on its label, namely -

4 · Time limit for display of labels.- A label containing particulars specified in regulalion 3 shall be displayed on every room air condilioner within a period of_ six months fromn the date of coming into force of these regulations.

5 · Manner of display o label. (1) Every room air conditioner shall display label at the time of sale and such label shall be eilher adhered t0, or attached as 3 swing tag; on it.

1 · Short tille and commencemenl: (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Room Air Condilioners) Amendment Regulations, 2010.

2 · In the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Room Air Condilioners) Regulations, 2009 (hereinafter referred to as the principal regulations) , in regulation 2, in sub-regulation (1).

7 · Grant of permission:-(1) On receipt of an application under regulation 6 and after being satisfied thal all requirements therein are complied with; the Bureau may, within a period of one month from the date of such receipt, grant, subjecl to such terms ad conditions as are specified in regulation 8, permission for affixing label on room air conditioner in Form-Il or in electronic form;

8 · Terins ana cordilions for display of parliculars on label. shall comply with (he following lerms and conditions, namely: -

9 · Label Fee_ (1) Every permiltee shall pay lo the Bureau a label fee of rupees thirty on each Iabel so affixed on the room air condilioner.

11 · Verification by the Bureau (1) The Bureau may, either suo motu, Or on Ihe complaint received by it, carry out verification to ensure that the room air conditioner conforms t0 (he star level and other parliculars displayed on its label and (hal it complies with the other terms and conditions of permission.

12 · Cancellatior; of Permission The Bureau may cancel the permission granled unaer regulaticn if the permitlee

(Name of the Distributor, dealer; retailer) under signatures of the duly authorised representative of the verification Agency as well as your representatives_

3 · The Bureau through its aforesaid Verification Agency had transported the sample referred to in para 2 to Mls. NABL accredited laboratory for conducting tests in accordance with the test procedure indicated in paragraphs 3 and 4 of S.O. number 18I(E), dated the [2th January, 2009 for giving Test Report in accordance with the Form given in Annexure to S.O. number 181( E), dated the 12th January, 2009.

5 · The Sample for second check verification Test were picked up in accordance with paragraph 4 of the S.O.number [8I(E), dated the [2th January, 2009 through our authorised Agency Mls. and transported to the NABL accredited Laboratory transported by our authorised Agency, duly sealed by Mls._ and was given Unique Identification serial number embossed on the said sample obtained from under signatures of the duly authorised representative of the verification Agency as well as your representatives.

6 · The Test results are contained in Second Test Verification Report duly prepared checked and counter signed by the competent authorized personnel of the NABL Accredited Laboratory. The test report is also duly signed by your authorised signatory as witness of Znd check testing: The Test Results confirm that they failed to meet the requisite parameters and standards given in S.O. number 18I(E) dated, I2th January, 2009 and the terms and conditions of the permission given to You for display of particulars on label affixed t the air conditioner manufactured and sold in the market

7 · Now, therefore in exercise of the power conferred by clause (a) of sub-regulation (4) of Regulation / lof the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Room Air Conditioners) Regulations, 2009, the Bureau hereby direct to

You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form V within 10 days after the expiry of two months i.e. by 201_ In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of clause (b) of sub-regulation (5) of Regulation ! of the Bureau of Energy Efficiency(Particulars and Manner of their Display on Labels of Room Air Conditioners) Regulations, 2009.
