7 · Categorisation o Open Access Customers (1) Subject 10 the provisions 0f regulation 6, the open access Customers shall be divided into two categories, based on thc du;alion of usc ofthe Intra-State Transmission System or the Distribution Systemn, namely a) Long tcrm Open Access Customcrs; Or (6) Short-term Open Access Customcrs_ (2) Thc persons availing Or intcrnding to avail of thc open access (Or period of one year or less shall be categorise :S the short-lerm acccss customers (3) The personsavailing or infending to avail ofthe opcn acccssfor a pcriod of more than five ycar shall bcthe long-terin open access customers Short-term open access customer shall be eligible to obtain fresh open access afier the expiry of the term and shallbe teated as a new applicant for capacity allocation. 8 Allotment Priority. (1) The priority for allowing open access shall be decided generally on the criteria that the long-term open access cuslomer shall be given priority Over the short-term open access CuStOnier (2) The open access shall be allowed only alicr determmg the capacity available in the inlra-slale transmission system and (he operational constraints including the capacity available inthe Distibution System. the utilisation thercof by the exisling cuStomers and the capacity already committed for Transmission, Distrbution and Retail Supply of Electricity to the consumers of the Distribution Licensces in the Statc (3) Subject to ihe above, the decision t0 allow Open access shall be made On the basis of first-come-firSt-serve The Commission may in the public interest and for IcaSOns t0 be recorded in writing: by a general or special order, deviate IrOm the nOrms provided above and allon' open access (0 any person inthe Intra-State Transmission System Ad oT (he Distribution System Determinatien of Capacity. 1) The availability of capciv in the Intra-Statc Transmission System for long-
