In exercise of the powers conferred by clause (e) of sub-section (2) of section 64 of the Water (Prevention and Control of Pollution) Act; 1974 and clause (aa) and (f) of sub-section (2) of section 54 of the Air (Prevention and Control of Pollution) Act, 1981, the State Government; hereby makes the following rules, namely: - 1. Short title and commencement: (1) These rules may be called the Rajasthan State Pollution Control Board (Qualifications and other Terms and Conditions of Service of the Chairman and Member Secretary) Rules, 2021. (2 They shall come into force from the date of their publication in the Official Gazette. 2. Definitions - In these rules, unless the context otherwise requires, "Act" means the Water (Prevention and Control of Pollution) Act, 1974 (Central Act 6 of 1947.); Board" means the Rajasthan State Pollution Control Board constituted under the Act; "Government means the Government of Rajasthan; and "Chairman' means the Chairman of the Rajasthan State Pollution Control Board; "Member Secretary' means the Member Secretary of the Rajasthan State Pollution Control Board. 3. Selection of the Chairman. (1) The Chairman of the Board shall be nominated by the State Government on the recommendation of the Search cum Selection Committee. The Search cum Selecti

2 · Definitions - In these rules, unless the context otherwise requires,
3 · Selection of the Chairman. (1) The Chairman of the Board shall be nominated by the State Government on the recommendation of the Search cum Selection Committee. The Search cum Selection Committee shall consist of the following, namely: - (1) Chief Secretary Chairman; (ii) Principal Secretary, Department of Personnel Member; (iii) Principal Secretary, Science & Technology Department Member; iv) An expert member to be nominated by the Chief Secretary Member Principal Secretary, Department of Environment Member secretary.
2 · The Search cum Selection Committee shall recommend the name of the selected candidate to the Department of Personnel for issue of order of nomination.
5 · Selection of the Member Secretary - (1) The Member Secretary of the Board shall be appointed by the State Government o the recommendation of the Search cum Selection Committee on deputation: The Search cum Selection Committee shall consist of the following; namely: (i) Chief Secretary Chairman; (ii) Principal Secretary, Department of Personnel Member; (iii) Principal Secretary, Science & Technology Department Member; iv) An expert member to be nominated by the Chief Secretary Member; Principal Secretary, Department of Environment Member Secretary:
6 · Educational and other qualifications for appointment as Member Secretary. No person shall be eligible for being appointed as Member Secretary of the Board under clause (f) of sub-section (2) of section 4 of the Act, unless he, a) is a member of All India Services in the service of Central or any State Government and holding a post on regular basis in the parent cadre O the department in the pay scale level 13A or higher of the Central Government or its equivalent in State Government, and b) Possessing a post graduate degree in science or a degree in Engineering from a recognized university or its equivalent with knowledge and experience related to environment
8 · Tenure - The term of service of the Chairman and Member Secretary shall be for a period of three years .
9 · Salary of the Chairman and Member Secretary. The Chairman and Member Secretary shall be paid monthly salary and allowances as decided by the State Government; from time to time.
10 · Power to relax _ Where the State Government is of opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules.
