The Goa Panchayat Raj (Qualifications and other Conditions of Service of Chairman and members of the Goa State Finance Commission) Rules, 1997 ______ GOVERNMENT OF GOA Department of Panchayat Raj and Community Development Directorate of Panchayats ________ Notification 9/DP/SFC/96 Whereas the draft of the Goa Panchayat Raj (Qualifications and other Conditions of Service of Chairman and members of the Goa State Finance Commission) Rules, 1996, were published as required by sub-section (1) of section 240 of the Goa Panchayat Raj Act, 1994 (Goa Act 14 of 1994), at pages 585 to 587 of the Official Gazette, Extraor- dinary No.2, Series I No. 41, dated 9-1-1997, under Notification No. 9/DP/SFC/96 dated 7-1-1997 of the Department of Panchayat Raj and Community Development, inviting objections and suggestions from all persons likely to be affected thereby before the expiry of fifteen days from the date of publication of the said Notification in the Official Gazette; And whereas, the said Official Gazette was made available to the public on 9th January, 1997; And whereas, no objections/suggestions have been received from the public on the said draft by the Government. Now, therefore, in exercise of the powers conferred by sub-sections (3) and (7) of section 199 read with sub-section (1) of section 240 of the Goa Panchayat Raj Act, 1994 (Goa Act 14 of 1994), the Government of Goa hereby makes the following rules, namely:— 1. Short title and commencement.— (1) These rules may be called the Goa Panchayat Raj (Qualifications and other Conditions of service of Chairman and members of the Goa State Finance Commission) Rules, 1997. (2) They shall come into force at once. 2. Definitions.— In these rules, unless there is anything repugnant in the subject or context, — (a) “Act” means the

1 · Short title and commencement.— (1) These rules may be called the Goa Panchayat Raj (Qualifications and other Conditions of service of Chairman and members of the Goa State Finance Commission) Rules, 1997.

2 · Definitions.— In these rules, unless there is anything repugnant in the subject or context, —

3 · Qualification for appointment as Chairman and members of the Commission.— The Chairman of the Commission shall be an eminent person, who is well versed in administrative and financial matters or a person with experience in public affairs and the other members of the Commission shall be selected from amongst the person who,—

4 · Disqualification for being the Chairman or member of the Commission.— A person shall be disqualified for being appointed as or for being a Chairman or a member of the Commission,—

5 · Term of office of Chairman and members.— The Chairman and every member of the Commission shall hold office for a period of five years but shall be eligible for re-appointment.

6 · Conditions of service and salaries and allowances of the Chairman and members.—

7 · Accommodation.— The Chairman of the Commission may, if he does not own a house at the headquarters of the Commission and if he so desires, be provided with unfurnished residence subject to the payment of rent and other conditions in accordance with the relevant rules for the time being applicable to officer of Grade I of the Government serving in connection with the administration of the State of Goa.

8 · (1) The Commission shall make recommendations relating to the matters as indicated in sub-section (1) of section 199 of the Act and also the matters as indicated in sub-section (1) of section 143 of the Goa Municipalities Act, 1968 (Act 7 of 1969).

9 · Procedure of the Commission.— The Commission shall determine its own procedure and shall have all the powers of the Civil Court under the Code of Civil Procedure, 1908 (V of 1908) while trying suits, in respect of the following matters, namely:—
