GOVERNMENT OF NATIONAL CAPITAL TERRITORY OF DELHI OFFICE OF THE COMMISSIONER; FOOD SUPPLIES & CONSUMER AFFAIRS_K' BLOCK_VIKAS BHAWAN; LR ESTATE NEW DELH No.3(129/2004/&SPP&C/ 325 Dated : 3ilelo4 ORDER Sub Departmental policy and eligibility terms and conditions for change in constitution in case of induction of partner; for PDS outlets. A number of requests have been filed in this Department for change of constitution relating to induction of partner and change of partners in the authorization letter for the PDS outlets. There are no Rules framed for this purpose and the guidelines prescribed suffer from a number of shortcomings In supersession of all previous orders, it is hereby ordered that i) The practice of induction of partners by changing the constitution should not be encouraged. However; in case of old age, infirmity and ill-health, members of immediate family may be inducted as partners. ii) It shall not be in the domain of the Department to decide or interfere in the share-holding arrangements of partnership of the authorized FPS. Partners should individually and severally be liable for any violation of the conditions of the license. iii) Partners should individually and severally possess the minimum qualification for holding an authorization to run a FPS. A proof in support of educational qualification should be attached alongwith the application: The applicant should not be proprietor or partner of a cancelled PDS outlet nor should be connected in any manner with another PDS outlet: The applicant should not have been convicted under the EC Act; 1955. The applicant should not be below 18 years or above 60 years of age-on the date of_ submitting application. iv) The partners shall abide by the conditions laid down in the Delhi Specified Articles (Regulation o
