122 · ANNEXURE – VII Detailed notifications are available in Division Office, Excerpts are being reproduced for ready reference – FOREST DEPARTMENT NOTIFICATION The 31st December, 1957 No. 6058-Ft-III-57/3305- In exercise of the powers conferred by Section 29 of the Patiala Forest Act, 1999 (No. VII of 1999 BK.) and all other powers enabling him in this behalf, the Governor of Punjab is pleased to declare the strips of Government waste lands demarcated by boundary, pillars, whether under tree growth or not, on either side of all roads under the charge of Public Works Department (Buildings and Road) in Patiala Civil Division (erstwhile Pepsu State) to be Second Class Forests and the provisions of Chapter V and Section 68 of the said Act to be applicable to them. No. 6058-Ft-III-57/3306- Whereas by Punjab Government, Forest Department, notification No. 6058-Ft-III-57/3305, dated the 31st December, 1957, all strips of Government waste lands demarcated by boundary pillars whether under tree growth or not, on either side of all roads under the charge of Public Works Deparment (Buildings & Roads) in Patiala Civil Division (erstwhile Pepsu State) have been declared as second class forests under Section 29 of the Patiala Forest Act, 1999 (No. VII of 1999 B.K.). Now, therefore, the Governor of Punjab, in exercise of the powers conferred by Section 30 of said Act, is pleased; (a) to declare all trees standing upon these lands to be reserved from the date of publication of this notification in the official Gazette;and (b) to prohibit, from the same date, the quarrying of stone or the burning of lime or charcoal or the collection or subjection to any manufacturing process or removal of any forest produce in any such forest and the breaking up or clearing for cultivation, for building for herding cattle or for any other purpose, of any land in such forests. No. 6058-Ft-III-57/3307- Whereas by Punjab Government notification No. 6058-Ft-III-57/3305, dated the 31st December, 1957, all strips of Government waste lands demarcated by boundary pillars whether under tree growth or not, on either side of all roads under the charge of the Public Works Deparment (Buildings & Roads) in Patiala Civil Division (erstwhile Pepsu State) have been declared as 123 second class forests under Section 29 of the Patiala Forest Act, 1999 (No. VII of 1999 B.K.). Now, therefore, in exercise of the powers conferred by Section 32 of the said Act, the Governor of Punjab is pleased to make the following rules applicable to all these lands specified under said notification :- RULES 1. No person shall cut, fell or lop any tree for any purpose whatsoever or remove any produce, without the previous permission of the Divisional Forest Officer for the time beyond of the Forest Division in which such lands are situated, provided that in times of emergency Executive Engineers incharge of the – (a) Roads, (b) Public Works Department (Buildings and Roads) may cut, fell or lop any tree for use on the- (a) Roads, (b) Public Works Department (Buildings and Roads) 2. No person shall herd, pasture, graze of retain sheep, goats or other cattle on the land in the Forests Department notification No. 6058-Ft-III-57/3305 dated 31st December, 1957. The Divisional Forest Officer of the Forest Division concerned may permit grazing by limited numbers of cattle. 3. No person shall clear or break up land without previous permission of the Divisional Forest Officer concerned. The Executive Engineer in charge of the roads may, however, permit the breaking of land and remove earth for use on roads in times of emergency. The Public Works Department (Buildings and Roads) may, however, permit the breaking up of land and remove earth fore use on road and when required. 4. No person shall cut or remove grass without the approval of the Divisional Forest Officer of the Forest Division concerned on the condition that the grass is cut above ground with shackle only. 5. No person shall set fire to grass, trees or timber, or kindle a fire on the land without reasonable precautions to prevent its spreading. 6. Income from compounding of offences against these rules under Section 68 of Forest Act, shall be credited to Government. . NAKUL SEN Secretary to Government, Punjab, Forest Department
