(1) इन िनयम$ का संि1 नाम खा सुरा और मानक (दूसरा संशोधन) िनयम, 2017 है । (2) ये राजप< म= काशन क तारीख को वृ त ह$गे। 2. खा सुरा एवं मानक िनयम, 2011 (िजसे इसम= इसके प? चात उB त िनयम कहा गया है) म= अह,ता से संबंिधत िनयम 2.1.2 (क) के उपिनयम 1 म=— (अ) खंड (i) म= “और” से आरंभ होकर “उपािध होगी” तक का लोप कया जाएगा; (आ) इस कार संशोिधत खंड (i) के प? चात िन निलिखत खंड का अतः सथापन कया जायगा, अथा,त;— “(iक) खा सुरा आयुB त, राH य सरकार के पूव, अनुमोदन से े< के उप-खंड अिधकारी को पदािभिहत अिधकारी के Iप मे अितJर# भार के आधार पर िनयुB त कर सकेगा ।” (इ) खंड (ii) अंत मे िन निलिखत को उपबंध अंत:स् थािपत कया जाएगा, अथा,त:— “परंतु यह क खंड (i) के अधीन को पदािभिहत अिधकारी के Iप म= िनयुB त े< का उपखंड अिधकारी को ऐसे िशण लेने क अपेा नहN होगी।” 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) शि# और क त,O य से संबंिधत उपिनयम 2 म= खंड (ii) के प? चात,िन निलिखत अंत:P थािपत कया जाएगा, अथा,त:— (iiक) जहां कलBटर या िजला मिजP Rेट आव? यक समझे, वहां वह खंड (ii) के अधीन उसके ारा योग क जाने वाली शि#य$ को कसी अपर कलBटर या अपर िजला मिजP Rेट या उस े< के उपखंड अिधकारी को यायोिजत कर सकेगा । [फा. सं. पी. 15025/242/2015-एफआर] सुधीर कुमार, संयुB त सिचव ट प ट प ट प ट पण : मूल िनयम, भारत के राजप<, असाधारण, भाग-II, खंड-3, उप-खंड (i) म= अिधसूचना संSया सा.का.िन. 362(अ), दनांक 5 मई, 2011 ारा कािशत कए गए थे और अंितम संशोधन अिधसूचना संS या सा. का.िन. 57(अ), दनांक 13 जनवरी, 2017 ारा कया गया । MINISTRY OF HEALTH AND FAMILY WELFARE (Department of Health and Family Welfare) NOTIFICATION New Delhi, the 13th December, 2017 G.S.R. 1516(E).—In exercise of the powers conferred by Section 91 of the Food Safety and Standards Act, 2006 (34 of 2006), the Central Government hereby makes the following rules further to amend the Food Safety and Standards Rules, 2011, namely:— 1. (1) These rules may be called the Food Safety and Standards (Second Amendment) Rules, 2017. (2) They shall come into the force on the date of their publication in the Official Gazette. 2. In the Food Safety and Standards Rules, 2011(hereinafter to be referred as the said rules), in Rule 2.1.2, (a) in sub-Rule 1 relating to qualification— (A) in clause (i), the portion beginning with “and shall possess” and ending with “under these rules” shall be omitted; (B) after clause (i) as so amended, the following clause shall be inserted, namely:— “(ia) The commissioner of Food Safety may with the previous approval of the State Government, appoint Sub-Divisional Officer of the area on additional charge basis as Designated Officer.” (C) in clause (ii), at the end, the following proviso shall be inserted, namely:— “Provided that Sub-Divisional Officer of the area appointed as Designated Officer under clause (i) shall not require to undergo such training.”; (b) in sub-Rule 2 relating to powers and duties, after clause (ii), the following clause shall be inserted, namely:— (iia) “Where the Collector or District Magistrate considers necessary, he may delegate the powers exercisable by him under clause (ii) to an Additional Collector or Additional District Magistrate or a Sub-Divisional Officer of the area.
