2 · Definitions. (I) In this Order, unless thc context otherwise requires (a) Act" means the Tea Act, 1953 (29 of 1953); (b) "Chaitian'` means the Chairman of the Tea Board and includes any person exer- cising, for the time being, the powers of the Cheirman ; (c) "Form' means a form appended to this Order; (d) "Licence" means a licence granted under this Order; 0) Licensee" means a licence holder of a liccnce; "Licensing Authority" means the Chair- man Or any other Offcer of the Tea Board So authorised by the Central Govern- ment in this behalf; (g) ~Tea Boerd" means the Tea Board established under section 4 of the Act; (h) ~Warehousc" means a covered shed or godown having a floor area measuring not less than 200 square metres wheein storing, blending Or packaging of tea is done;
7 · Fees for Licence _Every application for the issue of a liencc or renewal thereof shall be accompanied by thefollowing" fees, namely for the issue of a licence_Rs. 1000/- for renewal of' a licence-Rs. 200/- 8 Amendmenl of Licence.~The Licensing Authority may, of its own accord Of an applica- tion by the licensee, amend any licence granted under lhis Order in such manner a5 may be necessary to make such licence conform to the provisions of the Act o olher provisions of this Ordcrarany other Iaw fortheti:ne beingin force OI to reclily any crrors or omissions in the li- ce_cc
4 · Application for Licence. ~Every person desiring to obtain u liccnce shall make an 4ppli - calion to the Liccnsing Auhtority in Form A Thc Licensing Authority may call for additioal informalion and documents which may be consi- dered necessary in this regard,
5 · Grant 0r" refusal of licence - (1) Thc Liceusing Authority may, for reasons to be rccurded in writing, refuse to granl a licence to any apolicant and shall (urnish him with a copy of thc order so passed; (2) Where #n applicution for licence is nol refuscd under sub-clause ( /), thc Licensing Autho- rity shall grant the appli:ant a licence in Form B'_
9 · Duplicate liccnce. ~Tf tie Licensing Autho" rity is satisied that liccnce issued under this Order is defaced, lost, destroyed Or otherwise rend red useless, the Licensing Authority may, on applicalion made in that behalf and on paymcnt of a rupees one hundred issue 4 duplicate licence.
10 · Conditions of licence.- (I) Every licence shall bc deemed to have been granted Or renewed personally in favour of the licensee and shall not be transferable. (2) Where a licensee intends lo sell or transfer his business to another perSon, both the licensee and the proposed purchaser or the proposed transferee, as the case may be, must obtain prior permission of the Licensing Authority and the purchaser/transferce shall obtain fresh licence in his favour in accordance with the provisions of thig Order. (3) If a licensec entcrs into a partnership in regard to the business covered by his licence, be shall report the fact to the licensing authority within thirty days of his entering into such part- nership and shall get the liccnce suitably amended and thereupon the partner as well as the original holdcr of the licence shall be bound by the condi- tions of the licence as amended.
6 · Period of validity of licence.-(I) A licence isgued under this Order, unless cancelled OI suspended earlier, shall remain valid for a period of three years from the date of its issue and may be rcncwed for & further period of one year at 1 time.
1S · Power of entry, search and seizure: Licensing Authority OI any oflcer, of the Tea Board specially authorised by it in writing in this behall may enlor and search any warehouge for the purpose (f ensuring complianee with the prO- visions of the Order and may scize any tea or product of tea which appears lo be slorcd, blcndcd or peckaged in contravention of the provisions of this Order.
16 · Breach of conditions of licence to be deemed contravention of this Order:-~If any licensee commits any breach of any of the ters and conditions of the licence he shall be decmed to heve contravened the provisions of Order:
17 · Repeal and Saving:-Tea Warehouses (Licensing) Order; 1980 is hcreby repealed :
